Armour, Jonathan O. Armour, Michael Cudahy and George H. Webster, trad ing as Armour yesterday, through their attorney, 8. Spencer Chapman, asked Judge Pennypacker to enjoin Harry Clock and K. J.

Armer from using the flrra name of Armour Co. The petition says that the plaintiffs are wholesale packers and provision dealers, who have been established in Philadelphia since 1888, and that Clock Armer have since Feb ruary lis of this year formed a co partnership under the firm name of Armours Co. and opened a meat and provision store at 750 South Second street, where they have planed In the window a notice reading, "Armour Co. will open this store about March 1." They nave also distributed clroulars reading, Armour wholesale and retail dealers in meats and provisions. 756South Second street established in 1883." The plaintiffs claim that the defendants have no riifht to use the name "Armour as the member ot the new nrm is named Armer, and that the name Is used with Intent to deceive the public, and that as Armour the plaintiffs, are wholesalers only their customers, thinking they have entered into retail competition with them, have become dissatisfied and a number ot them have stonped dealing: with the plaintiffs.

Judge Pennypacker took the matter into consideration. It Will Not Affeot the Association. Harry P. Crowell, secretary of the Brewers' Association, In speaking about the purchase of the Rochester and Bartholomay breweries by an English syndicate yesterday said that It would have no effect upon the brewery Interest In Philadelphia as the two breweries were not members of the association and their sales were very Bmall in this city. "There are so many rumors of property being bought in this country by English syndicates," he said, "that I do not take much stock In the sale.

More than one half of the purchases have turned out to have been made by private capitalists. To Repair American AVar Vessels. Washington, March IS. Congress, at Its last session, made an appropriation of $160,000, to be expended in the repair of United States vessels, the money previously appropriated for this purpose baling been exhausted and the work having been suspended for several months. "Weeks Catches Fire and Narrowly Bsoapos Total Loss. Captain Henly, of the schooner A. R. Weeks, which put in at Delaware Breakwater on Friday, reports an exciting adventure that for a time endangered the livos of the entire crew. The schooner left Now York five or six days ago for Mantanzas with a miscellaneous cargo.

When three days out the woodwork of the cabin caught Are from the stove and in a few moments the entire interior was in a blaze. The crew at once commenced working for their lives, and in spite of a stiff wind whioh threatened to carry the llames all through the vessel, succeeded after several hours of desperate effort in getting the lire under control. The interior of the vessel, including the sleeping apartments of the crow, was completely burned out and the rigging and spars somewhat damaged. The vessel was at onoe headod for the Delaware Breakwater and encountered Friday's gale, which made her approach to the harbor very dilHcult She will be repaired at once and Eroceod to her destination. The cargo is not elleved to have sustained much damage.

Edgar Swan, of Lynn, paying teller of the National City Bank of Lynn, was before Commissioner Hallett this forenoon on complaint of Bank Examiner Catchell charged with being a defaulter to a very large amount. The total amount is re ported to be $68, 695. Of this, however, Mr, Swan has restored to the bank stock to the value of $38, 450.

Swan Is 35 years old, and has hitherto borne a good character. He has a wife and two children, and has lived beyond bis income in the enueavor to support them in style.
