has agreed to pay $58 million as part of a multistate settlement of allegations that its ads for the once-popular painkiller Vioxx deceptively played down the health risks. The agreement announced Tuesday also calls for Merck to submit all new TV commercials for its drugs to the Food and Drug Administration for review before they can be aired. Another provision of the settlement bars the company from "ghostwriting," a practice in which academic scientists were allegedly paid to take credit for positive research articles prepared by company-hired medical writers. The civil settlement ends a joint three-year investigation by 29 states and the District of Columbia into Merck's advertising practices involving Vioxx, Pennsylvania Attorney General Tom Corbett said. Vioxx was taken off the market in 2004 after research showed it doubled the risk of heart attacks and strokes.

That triggered thousands of lawsuits against Whitehouse Station, N. Merck. A pending $4.85 billion settlement would end the bulk of those personal injury suits. Additionally, for a 10-year period Merck must comply with any FDA recommendations to delay television advertising for newly approved pain medications.

Two studies published in April in the Journal of the American Medical Association mentioned alleged ghostwriting by Merck and also contended that the company tried to minimize deaths in two studies that showed Vioxx didn't work at treating or preventing Alzheimer's disease. Merck called the reports biased because five writers of the articles were paid consultants for people who sued Merck over Vioxx's heart and stroke risks, and a sixth testified about Merck and Vioxx's heart risks before a Senate panel. Merck is not admitting any wrongdoing under the settlement and defended its marketing of Vioxx in a statement Tuesday "Today's agreement enables Merck to put this matter behind us and focus on what Merck does best, developing new medicines," said Bruce Kuhlik, Merck's executive vice president and general counsel. Snapple Lady parts ways with company BY CARRIE MASON-DRAFFEN NEWSDAY MELVILLE, N.Y. She was the face that helped launch the Snapple brand nationwide.

But now Wendy Kaufman is officially the ex-Snapple Lady After years of hawking the beverage on TV, through voice-overs and goodwill appearances, Kaufman and Cadbury Schweppes have parted ways because of a new contract offer she said she could refuse. "I just couldn't accept the contract because it was so onesided and worth nothing," the Long Island native said. The contract would have paid her for appearances without a promise that any would materialize, she said. "It was an appearance contract based on whenever they felt like calling, she said. "I know they weren't calling me." The company offered a different take on the she-said, they-said breakup.

"The truth is, we offered her a fair contract for work performed instead of a guaranteed fee," said Greg Artkop, a spokesman for the Piano, Texas-based Dr Pepper Snapple Group, which was formed after Cadbury spun off its beverage business earlier this month. "It was her decision not to stay with Snapple and we respect that. We wish her nothing but the best in whatever she does in the future." Kaufman, 49, has been a spokeswoman for Snapple off and on since 1993. She had her longest run 1993 to 1995 when Snapple was based on Long Island and she worked in its marketing department. As the on-air face of the brand, Kaufman was known for her New York-accented greeting (Hi and hello from Snapple).

Airline industry reports March drop WASHINGTON (AP) The number of international air travelers flying in business or first-class fell in March by the largest amount in five years, the latest bad news for an industry buckling under record fuel prices and slowing global economies. The International Air Transport Association on Tuesday said premium air traffic shrank 3.9 percent in March compared with the same month last year, after growing by 5.1 percent in February. Although the drop was exaggerated both by the leap year adding an extra day to February and because March business travel fell due to an early Easter, it was the largest "absolute decline" in business and first-class passengers since 2003.

Feds, state agencies target phone scams WASHINGTON (AP) Federal and state officials announced a widespread crackdown Tuesday against telemarketing scams that have bilked thousands of consumers, many of them elderly, out of tens of millions of dollars. The sweep, dubbed "Operation Tele-PHONEY," was coordinated by the Federal Trade Commission and has yielded more than 180 enforcement actions in the United States and Canada. That makes it the largest such operation the FTC has ever coordinated, the agency said. William Kovacic, chairman of the FTC, said the 180 cases include new civil charges filed by the FTC against 13 telemarketers that defrauded more than 500,000 consumers out of $100 million. Oil settles above $129 for 1st time NEW YORK (AP) Crude prices spiked to yet another trading high Tuesday as supply concerns mounted.

At filling stations across the country, the national average price for a gallon of regular gasoline touched $3.80 for the first time, having followed oil's spectacular rise. The June contract for light, sweet crude traded as high as $129.60 on the New York Mercantile Exchange before settling at $129.07, up $2.02 from Monday's record high. Wholesale inflation slows in April WASHINGTON (AP) Wholesale inflation slowed in April following a big jump in March but the improvement is likely to be temporary as consumers are battered in coming months by price hikes for gasoline, food and a host of other items. Most worrisome of all, analysts said, were indications that surging energy and food costs were spreading to other parts of the economy, causing more widespread inflation problems. For April, wholesale inflation was up 0.2 percent, the Labor Department reported Tuesday, following a much bigger 1.1 percent jump in March.
