DEAR ABBY: I have a young neighbor who has children about the ages of mine. Our children play together constantly at either my house or hers. It seems the only way this mother can discipline her children is to tell them if they aren't "good" she will call the policeman. Now it's none of my business how she wants to raise her c h 11 d r e n, but I do. not want my children .to. grow up being afraid of policemen. Should I say something to this mother? K so, how do I put it without getting her angry at me? A.NEIGHBOR DEAR NEIGHBOR: Tell her that for her own isfety children i h o uId be taught that the policeman is their friend because should a child be lost, hurt or molested by a s t r a n g e r, he should aik the nearest policeman for help. If yon explain this to your neighbor «he will rarely understand and change her threats. DEAR ABBY: When I was 16, I lost the thumb and first two fingers from my right hand in a hunting accident. This is my problem: People are always wanting to shake hands with me, which has given me many awkward moments. . They become offended or embarrassed if I do not shake. hands with them. I.have tried wearing a glove, but. people are not very observant and they put out their hand, anyway. I don't think I ought to apologize for my hand. Any suggestions? •'-..'. .-' »,C. DEAR S. TM AN ORDINANCE GRANTING A FRANCHISE TO BLVHBVILLE TV CABLE COMPANY, ITS SUCCESSORS AND ASSIGNS, FOR THE PURPOSE OF CONSTRUCTING, ACQUIRING, OPERATING AND MAINTAINING A COMMUNITY ANTENNA TELEVISION SYSTEM IN THE CITY OF BLYTHEVILLE, ARKANSAS; PROVIDING CONDITIONS, REQUIREMENTS AND REGULATIONS THEREFOR; PRESCRIBING PENALTIES AND VIOLATIONS OF ITS PROVISIONS; AND FOR OTHER PURPOSES. Section 2. The term of this ranchise shall be for twenty 20) years from the beginning f service through a community ntenna television system, but n no event more than 18 months rom the date hereof. Whenever the Company shall take up or disturb any pavement, 'sidewalk, or other improvement of any street, avenue, alley or other public place, the same shall be accomplished under the control and supervision of the Office of the City Engineer and sama shall be replaced and the surface restored in as good condition as before entry within forthy-eight (48) hours after completion of the Company's work. Section 8. In the event of the failure of the Company to render community television service in the City c Blytheville as . contemplated and provided 'or. by this Ordinance with a seriod of eighteen (18) months :rom the effective date of this ordinance, the City Council or the City of Blythevllle shall lave the right to declare this Ordinance and the rights and franchise granted thereunder forfeited!' Should the Company discontinue service for a period of sixth (60) days after its system has been instituted, the City of Blytheville shall have the right to declare this Ordinance and the rights and franchise granted thereunder forfeited and make a written demand on the Company, to proceed to remove their cables, wires and other facilities from the City streets, lanes avenues, sidewalks, alleys, highways, other public places and from, the premises of Com- pany's' subscribers within thirty (30) days from the date of such demand; further, should the 'Company fail to proceed with removal of aforesaid facilities, .after receipt of notice,, the City shall have the right to remove-same and retain it as the absolute property of the City, without accounting there- for to the Company and the expense of such .removal shall be charged to and paid by the Company, without credit for the value, if any. Section 9. The Company shall indemnify and hold the City harmless at all times during the term of this grant from anc against all- claims for injury or damages to persons or property both real and personal caused by the construction, erection, operation or maintenance of any structures, equipment, appliance or products authorized or used pursuant to authority of this Ordinance. The Company shall, at all times during, .the existence of this franchise carry and require their contractors to carry suit of the violation or failure on the part of the Company, its successors' and assigns, to observe their proper duty or because Of negligence in whole or in. part (rising out ol the construction, repair, extension, maintenance or operation of their -distribution lines, amplifiers, or equipment of any kind or character used in connection with this permit or franchise. ' Section 10. If the Company shall fail to comply with any of the provisions of this franchise, or default in any of their obligations except for causes beyond reasonable control of the company and shall fail, within thirty (30) days after written notice from the City to correct such default or noncompliance, the City shall have the right to repeal this Ordinance and all rights of the'Company hereunder. ; Section 11. The company shall furnish, free of charge, one service distribution connection to each school located within the corporate limits of the City of Blytheville, one service distribution connection to the City Hall and to each of the Fire De- lartment stations within the :orporate limits of the City of Blytheville. Section 12. The Company shall ?ay, and, in consideration of the granting of this franchise, igrees to pay to the City of 31ytheville as a franchise tax payment. . i / Section 13. -The franchise pay. ments herein provided for shall be in lieu of any business or occupation licenses or taxes, but shall not be in lieu of ad valorem taxes assessed with, respect to real or personal property of the Company by the City. . . ::•< Section 14. Records and Re-' ports. The City shall have access at all reasonable hours to all 'if the Company's plans, contracts, and engineering, accounting, financial, statistical; customer and service records relating to the property and ;t0 the operatioi. of the Company and to all other records requir?! ed to be kept hereunder. The following records and reports shall be filed with the City Clerk and in the local office of the Company: (a) Company Rules and? Regulations. Copies of such" rules, regulations, terms 1 , and conditions adopted by" the Company for the con- 1 duct of its business. (b) Gross Revenue. An; •> annual summary report showing gross revenues re:., ceived by the Company'" 1 from its operations within" and outside the City during' 1 '' the preceding year and ;• such other information as- the City shall request to" properties and expenses related to the Company's service within and outside the City. Section 15. The Company shall, pay the City the cost of publishing this-Ordmance according to law. Section 16. This Ordinance being necessary for the comfort, convenience arid welfare' of the City of Biythevffle, Arkansas, and the inhabitants thereof, an emergency is herfc by declared to exist and' this Ordinance shall take effect and be in force after its .passage,.; Passed and approved this .13 day of September, 1966. Attest: Jimraie Edwards, Mayor and finding of such interference, such shall be cause for the repeal of this ordinance and termination of the franchise granted herein unless said interference be eliminated within 30 days after such finding by the Council. Should said Company make available 'radio broadcasts, local radio, both F'M and AM shall be made'available to its subscribers; further, should i television station that originates its own audio signals and visual images be established in ;he City during the period of'this 'ranchise, said television 'station's programs "will be made available by the Company to its subscribers. Section 5. The Company, shall not engage in sales, or services of television or radio receivers. Section 6. The Company's transmission and distribution system, poles, wires, and appurtenances shall. be located, erected and maintained so as not to endanger or interfere with the lives or persons or to interfere with any Improvemens the City may deem proper to make, or to hinder unnecessarily or obstruct the free use of the streets, alleys, bridges or other public property. Construction and maintenance, of the transmission distribution system, including house, connec? tions, shall be in accordance with the provisions of. the National Electrical Safety Code, prepared by the National Bureau of Standards, the National Electrical Code of the National Board of Fire Underwriters and such applicable ordinances and regulations of the City of Blytheville affecting electrical installations which may be presently in effect or may be enacted by the City c' Blytheville. Section 7. In the maintenance and operation of their television transmission and distribution system in the streets, al leys and other public places, and in the course of any new construction or addition to their facilities, the Company -shal' proceec as to cause the least possible inconvenience to the general public; any opening or obstruction in the stretU or (a)Insurance i such form and in such companies as shall be approved by the City Attorney, of the City of Blytheville ' to protect the City and themselves from and against an.' and all claims of injury of damages to persons or property, both real and personal, caused by the construction, erection, operation, or maintenance of any structure, equipment, appliance, and the amount of such insurance against liability due to damage to property shall not be less than One Hundred Thousand Dollars- ($100,000.00), as to any one person, and Two Hundred Thousand Dollars ($200,000.00), as to any one -accident, and against liability due to injury or death of persons, One Hundred Thousand Dollars ($100,000..00), as to any one person and Three Hundred Thousand Dollars (?300.000.00), as to any one accident. (b) Workmen's compensation insurance, in compliance with the laws of the State of Arkansas. (c) Automobile liability insurance with limits of not less than $100/300,000.00 and automobile liability property damage insurance with a limit of not less than Ten Thousand Dollars ($10,000.00) to cover all automotive equipment. The Company, upon receipt of due notice in writing from the Ci'.y, shall defend at their own expense, any action or proceedings against the City of Blytheville in which it is claimed that the injury or damage arose from the Company's activities in the construction or operation of their television system; and in the event of a determination of liability, shatl indemnify the City, more particularly, the Compai.y, its sue cessors and assigns, does hereby agree to indemnify and hold harmless the City of Blytheville from any and all liability, claim, demand or judgement growing out of any Injury to any person or property as a re- and as compensation for the right and privileges enjoyed hereunder, a sum equal to five (5) per cent of gross receipts received by the Company from its customers within the City limits of Blytheville and a sum equal to five (5) per cent of gross receipts received by the Company from its customers Outside the City of Blytheviile, excepting incorporated towns and cities. Said payment shall be paid annually on the first day of February of each year for the previous calendar year, and, if requested by the City, Company shall post sufficient bond to guarantee such annual _ , . .
