JONES By VICTORIA SUN Associated Press Writer LOS ANGELES Robert Mitch-ums road to Hollywood was as rough-and-tumble as any of the mavericks he played in more than 100 Westerns, war movies and dramas. He drifted into acting from a gritty life similar to that of the characters he went on to play. He was arrested for vagrancy as a young man, and claimed to have dug ditches, cleared swamp brush and built roads while serving time on a Georgia chain gang, He escaped and eventually hopped a freight car to Los Angeles. Mitchum, who was a star for a half-century but never won an Academy Award, died in his sleep Tuesday at his Santa Barbara County home after a yearlong battle with emphysema and lung cancer. He was 79.

Just a week earlier, he had begun radiation treatments. From1 a menacing ex-con in 1962s Cape Fear to a private eye in Farewell, My Lovely" in 1975, Mitchum was a prolific actor who earned his ticket to stardom. But he eschewed glitz and glamour. He was a legend, a giant, bigger than life, said Bruce Dcrn, who co-starred with Mitchum in 1982s That Championship Season. I was lucky enough to work with him.

He was always at the top of his game." On screen and off, Mitchum was hard-drinking and surly. Over the years, he told so many tall taled about his youth that it became hard to sort out the truth. His arrival in Los Angeles aboard a freight car in 1937 was just another scene in the drama he lived every day.

He played a crewman in 1944s Thirty Seconds over Tokyo and a villain in a Laurel and Hardy feature. He even appeared in a musical Western.

His star rose in 1945 when he received his only Academy Award nomination, for his role of Lt. Walker in The Story of G.I. Joe." His hero status was in danger when he was arrested in 1948 for possession of marijuana at a friends home. After serving 60 days in an honor farm, he bounced back to say: Its just like Palm Springs without the riffraff. His popularity with producers and the public soared after his return to film beginning with the 1949 film, "The Red Pony.

Mitchums last picture, James Dean: Race with Destiny," set for release on Sept. 30, also stars his granddaughter Carrie Mitchum. His scenes were shot in late 1995. "I was impressed because you could tell he was weak even then, yet fire came to his eyes when the cameras began rolling," said writer associate producer Dan Scfton. Mitchum is survived by his wife of 56 years, Dorothy; his actor sons, James and Christopher; daughter, Petrine; five grandchildren and one step-grandchild.

The funeral will be private and Mitchums ashes will be scattered at sea.
