An Associated Press poll prior to the start of todays vote showed 49 senators opposing a motion to recommit and kill the nomination to the Judiciary Committee, 39 for and 10 uncommitted. Since two senators could not make todays session, 49 nay votes insured at least a tie, thus setting up a tie-breaking vote in favor of the nomination by the Senates presiding officer Vice President Spiro T. Most of it centered around the Democratic nomination for U.S. Senate and the unannounced candidacy of Sam Grossman, Phoenix shopping center owner. Early speculation was that Stewart Udall, former Secretary of Interior, might want that nomination. And if he wanted it, very likely he could have it.

But Grossman seems confident Udall wont make the race. Now comes word from Washington that Udall hasnt made any decision as yet, although there have been some new stories that Udall has decided not to oppose Sen. Paul Fannin. Orren Beaty, who writes an "Arizonans in Washington column for the SUN, said Udall has not made a decision. Beaty reports: A poll taken in Phoenix and Tucson a few weeks ago basis for the story that the former Secretary of Interior would not run showed Fannin with a strong lead, it is true.

But it also showed that Udall is well known and would not have a campaign early in order to a-chieve the 'name identification necessary for victory. Beaty, a former Phoenix newsman who once worked for Udall, also had some interesting comments about Republican efforts to gain control of the U. S. Senate in this years election. While much of the analysis has centered on who can win where, and what Democratic senators are vulnerable, Beaty points out that a key factor in the battle for control is the shifting of party allegiance by some southern Democratic senators.

If several such senators switched party allegiance, it might mean that Republicans would need to win only three or four additional seats instead of seven that they must gain under present circumstances. The senators who make the shift undoubtedly would have to be guaranteed their seniority and committee chairmanships with them, but GOP leaders probably would be willing to do this in exchange for control of the Senate. Beaty's ovservations will add a bit more spice to a campaign that is pretty well-seasoned already. New Flagstaff TV Station Emits Signal Flagstaffs new television station, KOAI, broadcast its first signal and test pattern last Friday at 2:37 p.m. Wendell Elliot, president of Grand Canyon Television said that the test pattern will be used until the station program authority comes which he expects will take about 10 days.

As of yet, no cable channel has been assigned by the Flagstaff TV and Cable to the new station. However, Bob Cowley of the Cable said that a cable channel will be assigned to the station as soon as he knows the exact date for program broadcasting by the station. I Pausing for. Nixons first choice, Judge Clement F. Haynsworth of Greenville, S.C., was rejected by the Senate last November by a 55-45 vote. Senate leaders of both parties said they expected defeat of Bayhs recommittal motion to be followed by confirmation of Carswell, although perhaps by a narrower margin.

Some senators who voted against recommittal said they would vote against Carswells confirmation. They contended that returning it to committee would just be ducking the issue. On the other hand, some senators who announced they favored returning the nomination to committee for further hearings said they would disclose later how they would vote on confirmation if the recommittal motion failed.
