Aggatl Masalaski, a young unmarried Lithuanian woman, residing at No. 407 Deacon street, was arrested last evening by Patrolmen Lutz and Stevens, on the charee of infanticide.

Joseph Asorovitch. of 307 Oak street, was taken Into custody as her accomplice. The officers, together with Mrs. Joseph Miller and Rosalie Waitkevltch, were the principal witnesses against them. The story told by the accusing women, who reside at 221 Parker street.

Only a few cases were ar gueti. Before Judges Lynch and Wheaton the case of W. and C. Cava. naugh, of Avoca, against the Avoca Coal Co.

was argued by Attorneys A. Lynch, and W. H. Hlnes for the plaintiff, while John McGahren was counsel for the defense. The case was tried at a recent term of court and the plaintiffs asked for damages, for the death of their son, who was killed by the explosion of the company's boiler.

The company claimed that it was not responsible for the accident, but that young Cavanaugh was really respon sible for the explosion by allowing the water to become low in the boiler. The jury gave a verdict In favor of the plaintiffs and now the defense asks for a r.ew dial and arrest of judg men, on which yesterday's argument was held. The attorneys for the de fense claimed that the case should have been taken from the jury. The court took the papers. The case of George W.

Everhart against the Lehigh Valley Coal In which a new trial Is asked for, was argued before Judge Halsey and was ordered to be marked off the list. At torneys G. P. Bedford and H. A.

Fuller were for the plaintiff, and J. B. Woodward. for the defense. MAN MISSING. A number of foreign speaking residents are considerably concerned over the mysterious disappearance of Alex, Harcarik, who had a business place on North Main street, Wilkesbarre. Har carik was a dealer In cemetery goods, such as Iron fences, tombstones, and has been in business about three years. He acted as an agent and succeeded In securing orders for a large amount of cemetery goods from Slovaks and other foreigners all over the valley. He secured a small advance deposit from each one, amounting to from $10 to $30 and from one of the priests secured $100.

One week ago last Friday he disappeared and has not been seen since. It Is estimated that he had collected about $1,500, tor which no return has been made. Inasmuch as the loss per man was small it Is unlikely that he will be sought Taxes. Duplicates for State County and Poor taxes for 1906 in the City of Pittston, have been rqcelvedby me, and payment of taxes will be required to be made at the city treasurer's office, room No. 2, Miners' Bank building.

27. 1901. 27 10 OUT OF BUSINESS. Oliver Burke, for the past 26 years one of the prominent saloon men of this city, retired from the business yesterday, when his license was transferred to James Carroll. Mr.

Carroll has already assumed charge. Mr. Burke's business was one of the best conducted in the city and the Susquehanna; House was always largely patronized by a quiet but extensive trade. Mr. Burke will take a rest for some time before entering upon a new line of business.

The July gross earnings of the On tario Western showed an increase of approximately $100,000, and as the expenses of operation were practically the same as In the preceding July, notwithstanding the fact of the larg er business done, the increase, of $100,000 Is more than maintained in the net earnings. As a result, after the deduction of only slightly increased charges, there was still an Increase of about $100,000 in the surplus over charges. This is a good showing for the On tario Western, and is due, to a considerable extent, to the improvement in the freight earnings of the road.

The effect of the establishment of the new fast freight line in and out of the New England Is being felt, and the New Haven Is doing more and more for the road In the way of giving it traffic as time goeson. If the present rate of Increase of surplus could be maintained through out the year, the outlook for the stockholders would be considerably Improved. There is reason to believe that the stockholders are likely to get the benefit of the increases In the amount earned in excess of charges. The policy of the last two years has been to declare in dividends practically all that has. been earned, so that a material increase of surplus earned would be of importance the stockholders on account of the possibility of a distribution in the form of dividends.

Another large payment was made on the new court house yesceraay. the exact amount 'being $50,798.16. This is the largest single payment that has been made on the building since the beginning of its erection and indicates that unusual progresis, has teen made, the past, court house fund Is now about exhausted, and It will be necessary to issue the bonds that have been held un the past two years owing to the cessation of work at the new building. Frank Carlucci, the head of the Carluccl Stone expects to have the building entirely under roof before the end of another six weeks and does not 'believe there will ber anything in the way of continuing work on the Interior all winter. The dome is now being erected and it is so high that it can be plainly seen for a long distance.
