The case stems from a March 2016 lawsuit brought by Com- stock Construction, which ar- gued the State Historical So- ciety breached its contract by improperly withholding pay- ment. The firm also pointed to inadequate plans to support limestone panels, which it said caused damages and delays. The Wahpeton-based claims total more than $2 mil- lion. has been harmed by the state and its said Aaron Dean, attorney.

Comstock was the gen- eral contractor for the Her- itage $51.7 million, expan- sion, which first opened to the public in 2014. The project roughly doubled the size of the original museum. The State Historical So- ciety has alleged Comstock breached its contract by not installing limestone panels according to specifications, removing its superintendent without the consent and not completing the project on time. It filed a counterclaim seeking at least $50,000. The proceedings began Monday morning with jury se- lection at the Burleigh County Courthouse in downtown Bis- marck and ended with Com- stock project manager Jason Flack on the stand.

He and Michael Comstock, an owner of the firm, declined to com- ment outside the courtroom. Meanwhile, State Historical Society Director Claudia Berg and Facility Management Di- rector John Boyle were in the audience Monday. Berg and Peter Zuger, the attorney rep- resenting the state in the case, said they comment during the trial. The trial could stretch until the middle of next week, ac- cording to court records. Bismarck Police Sgt. Mark Buschena said the man is 37- year old Jesse Engesser, of Bismarck. No charges have yet been filed but a report has been sent to the Bismarck city attorney for review, according to Buschena. The 11-year-old girl was crossing to the school bus at the bus stop at 7:30 a.m. Friday near Jericho Road and Jordan Street when a vehicle struck her right abdomen with its pas- senger side mirror and ran over both her feet.

She was taken to a hospital. The driver, identified later that day as Engesser, reportedly exited the vehicle, yelled at the girl then drove away. She told police the bus was stopped with its stop sign ex- tended and lights flashing at the time she was struck. Engesser has a criminal re- cord, including sexual assault, DUI and theft charges since last year. Meds reported stolen from shelter A former resident of Ruth Meiers Hospitality emergency shelter has reported his prescription med- ications were stolen.

Bismarck Police took the report Saturday from the 57-year-old Bismarck man, who is now in jail. He told po- lice his medications were sto- len in late January while he was staying at the shelter at 305 N. 23rd St. The man said he waited un- til now to report the theft be- cause he thought the medica- tion, which had been locked in a medication locker, might be returned. Flags to fly at half staff Gov. Doug Burgum has di- rected all government agen- cies to fly the United States and North Dakota flags at half staff until sunset Thursday and encouraged North Dakotans to do the same at their homes and businesses, as a mark of re- spect for the shooting victims who were harmed at a church in Sutherland Springs, Texas. At least 26 people were killed and 20 injured on Sunday. The directive is in ac- cordance with a proclamation issued by President Donald Trump. Fire prompts evacuation of Ramada Inn The Ramada Inn in Bismarck was evacuated Friday due to a fire on the outside of the build- ing, according to a news release from Bismarck city officials. The Bismarck Fire Depart- ment responded to a report of smoke on the first floor of the hotel, 1400 E. Interchange at 9:19 p.m.

When fire personnel arrived, they evac- uated everyone from the build- ing. There was light smoke on the first floor and heavy smoke on the second floor of the east wing, according to the release. A fire was found on an outside wall of the building, near a ventilation unit. It took more than four hours to ventilate the building, and a preliminary fire loss estimate is $100,000. The cause of the fire remains under investigation.
