Court of Appeals in Washington to delay it Last Tuesday Judge Joseph Waddy of US District Court rejected a state bid for a 2-year or 3-year moratorium on the sale The state argued that the sale should be postponed because of environmental considerations The attorney general Avrum Gross said Friday that the appeal of ruling will be based on the contention that the judge too much credence on the To Deny Probe Into His Activities St Louis Former Gov Warren Hearnes has asked federal prosecutors to state that there never has been a criminal investigation of him or of alleged corruption in his administration according to the St Louis Post-Dispatch However the newspaper said in editions that US Attorney Bert Hurn of Kansas City rejected the proposal saying he could not agree with parts of it Hurn said he would not elaborate but would issue his own statement in about a week Part of the statement Hurn was asked to read said have been misquoted many times in this inquiry and in the past and I do not want to be misunderstood at this time I will only unequivocally state at this time as simply as possible that there never was an investigation of the individual Warren Hearnes or Hearnes as such that the work my office did as to Warren Hearnes was at the request of the IRS and I understand that this investigation is now proposed statement was given to Hurn shortly after Hearnes announced April 1 that the Internal Revenue Service told him it was discontinuing a criminal investigation of him for possible income-tax fraud Hurn had been asked by Hearnes to issue a statement in conjunction with that announcement The IRS began a criminal investigation of financial affairs in late 1974 Early in January 1975 a federal grand jury began an investigation in conjunction with the IRS inquiry An assistant US attorney said at the time that Hearnes was being investigated for possible extortion fraud and conspiracy in addition to possible income-tax violations Hurn refused to comment on whether
