and Mrs. E. Frapwell left for the Big Sur Monday, where they will meet their son, Elvis Frapwell, and together with Mrs. Frapwell and their baby, enjoy a week camping, hunting and fishing. Miss Ila Robinson left for her horns in Millers Falls, after a summer vacation with her cousins, Mrs.

Holm and daughter, Veronica, Mrs. William Bennett and daughter, Mrs. Tom Hunt, ave spending a ten day vacation on the summit at Section 11 with William Bennett, who has charge of that section. Dante Locatelli and Eug Erick-son brought home a large deer which they killed Sunday morning on the China grade. A picnic and hunting party was enjoyed Sunday by a number of local people and their friends.

The China grade was chosen as a likely place to find deer and two were killed. Manuel Rodriguez and George Clarke were the lucky ones to kill the deer. Among the party were Mr. and Mrs. G.

Snioot, Mr. and Mrs. George Clark, Frank Wal-trip of San Jose, Mr. and Mrs. R.

Greenfield, Mervin Greenfield, F. Strickland, Mr. and Mrs. J. Moses of Santa Cruz, Mr.

and Mrs. Joe Motire, Sherman Waltrip and Manuel Rodriguez of Boulder Creek. The deer were large, fine specimens. Sherman Waltrip killed a fine deer last week a few miles about Boulder Creek. Jim Maddock, Arthur Waters and Frank Clement went hunting Sunday on the Santa Cruz Lumber company camp grounds on the San Lor- 17 Mission St.

As a result of an automobile crash on the Santa Cruz highway near Rio Del Mar Sunday at about 5 p. m. Harry Rafler of Soquel was arrested on a charge of reckless driving. He appeared before Judge C. R.

Taylor in justice court at Watsonville and was fined $100 on the charge yesterday. According' to the testimony in court yesterday the accident happened when Rafler attempted' to pass a number of cars in front of him as he was traveling to Santa Cruz with heavy traffic going both ways. As he left his own lane he sideswiped a car driven by G. Bec-caria, who brought the reckless driving charges against him. No one was hurt in the crash, but the two cars' were badly damaged.

Rafter's car landed in the ditch at the side of the road. It was alleged that after the crash Rafler hit Beccaria with his fist behind the left ear when Beccaria attempted to keep him from leaving the scene of the wreck. In the opinion Judge James L. At-tcridge says that in the instrument which plaintiff pleads as a lease was not signed by him as lessor and consequently fails in that essential requirement of every valid lease. It is also defective in other particulars.

Defendant as a consequence of the failure of the instrument to conform to the legal requisite of a lease, was entitled to terminate the tenancy at any time, which it did at a period of time, when it was not in arrears in its payment of rent. Plaintiff is to take nothing on the first cause of action.
