wi Saskatoon, Saskatchewan Star Phoenix Saturday, November 18, 1989 B12 National Ru ir ii heicahl Potential fathers cant prevent abortions, said the Supreme Court, whose nine justices unanimously overturned the injunction in an oral ruling Aug. 8. Daigle, 21, who obtained an abortion in Boston before the Supreme Court decision was made, said Friday she doesnt regret her decision. Speaking quietly to reporters at a news conference, Daigle said she would do the same thing again under similar circumstances only this time I wouldnt tell my companion (about the pregnancy). Twice, they didnt listen to tion, because thaf will mean referrals to a doctor to see if you have a right to an abortion, and that could advance your pregnancy.

In my case it was the court that advanced my pregnancy from 18 to 20 weeks, she said. A woman doesnt abuse abortion. Its a decision she makes and she thinks about it before going ahead. Tremblay, responding earlier to Thursdays ruling, said he regrets the whole thing. I lost my baby and it cost me a lot of money, he said, adding that hes been unable to find work because of the publicity surrounding the case.

VAL-DOR, Que. (CP) Chan-tal Daigle, who won her battle last August for an abortion despite the opposition of her former boyfriend, says shes pleased with the Supreme Court of Canadas ruling on her case. When the injunction was lifted I was very touched, but having the judgment yesterday made me even happier, Daigle said Friday. In issuing its wfitten reasons on Thursday for quashing an injunction against the abortion, the Supreme Court ruled fetuses do not enjoy a right to life under the Quebec Charter' of Rights or the provincial Civil Code. be made by a woman and doctor.

Its the womans decision. She needs medical services but she doesnt need to know what the doctor thinks about it. You can be fit and still want an abortion because its your own business, its your private life. If the government ever decides to protect the fetus a limit will be established but until then it should be a womans decision. The way it is proposed in remote areas without a lot of doctors, will you have to start shopping? Daigle also criticized the bill.

"I dont agree that you have to go through a doctor to have an abor me, Daigle said, referring tp the decisions of Quebec Superior Court to grant the injunction to Daigles ex-bovfriend Jean-Guy Tremblay, and of the Quebec Court of Appeal to uphold it. But this time they took into account what I and my lawyer said. Daigle said she is now living with her father in Chibougamau, and working in an office. I still want a family when Im ready, she said, adding she doesnt have a boyfriend now. Daigles lawyer, Daniel Bedard, said the ruling makes it clear a woman does not need the consent of the potential father and the father cannot be an obstacle nie Flam, 75, was murdered, her sister-in-law was severely beaten and their home was set ablaze in nearby Chatham.

Near the scene of Thursdays murder, two young men said most people believe the husky, dark-haired Legere is the killer. It couldnt be nobody else, said one. Old people, women and priests, thats sick. Smiths attackers, who jimmied a safe in his rectory, ap- Police think killer has an accomplice to the decision to have an abortion. Its a victory for every Canadian who thinks that your body is your body, he said.

But he didnt have much good to say about a proposed new bill which would put abortion back in the Criminal Code, replacing a law struck down by the Supreme Court nearly two years ago. Under the proposed law, a woman would be able to terminate her pregnancy at any stage if a doctor concluded that having the baby might endanger her physical or mental health. It demonstrates paternalism, said Bedard. The decision should parently got into the house beside the Nativity of the Blessed Virgin Mary Church by stealing a neighbors ladder and leaning it on the veranda. Smith was the fourth person killed since Legere, a convicted murderer, escaped from guards in Moncton, N.B., last May.

He and two other men were serving a life sentence for the 1986 kill-' ing of an elderly shopkeeper in nearby Black River Bridge. Youre dealing with a strange character up there. Legere, 41, has been feared in the region for years, said Gough, comparing him to multiple-murderer Noel Winters, who terrorized Saint John, N.B., before he committed suicide in Dorchester Penitentiary on April 24, 1984. Like some serial killers, Legere serving a life sentence for the 1986 murder of John Glendenning, a shopkeeper in nearby Black River Bridge, N.B. was not perceived as a crazed individual.

His former parole officer, Bob Ross, once recalled how the bearded, dark-haired woodsman would paint and draw along themes depicting the underdog, probably seeing himself in the same way. He certainly is a deep thinker and friendly on the street hes not a recluse or anything like that, said Ross at the time. Killer perverted, sophisticated The day he was convicted for that, he said he was going to terrorize this town, a woman said Friday in a local coffee shop. He has done that because Im scared to death. Police familiar with Legere have compared him to Manson, the crazed California cult leader who had followers do his bidding in a number of 60s killings.

They say Legere sometimes has others do his dirty work. I always found him to be a gentleman. Elliott Leyton, an anthropologist at Newfoundlands Memorial University, said serial killers are hard to read and their problems cannot usually be traced to profound biological or psychiatric abnormalities. Over and over again, these are people who just felt their social ambitions were foiled, said Leyton. Theyre mad at certain ethnic group or class or social type and they begin to harbor a sort of campaign of mindless vengeance against them.

Legere, a high-school drop out, is known as a good talker, a man gifted with the facility to be friendly when he feels it necessary and vicious when theres something he wants. Married twice, he has at least two RCMP said the man believed to be involved with Legere is 20 to 25 years old, six feet tall and with reddish-brown hair. When last seen he was wearing the brown liner from a hard hat, a police spokesman said. A word of caution to friends and associates: Allan Legere is to be considered one of the most dangerous and wanted criminals in Canada, he said. Despite hundreds of sightings across New Brunswick and as far away as Texas, police have been unable to catch Legere.

A master woodsman who grew up around Newcastle, Legere knows the area like the back of his hand. Frustrated police have said repeatedly that someone because of fear or loyalty is a vital piece of information that will lead them to Legere. Rivard said he does not need reinforcements for the more-than 100 officers already assigned to investigate the murders and search for Legere. I have all the investigators I need and ali the expertise I need to conduct the investigation. All I need is that one piece of information that will get me Allan Legere.

On Friday, tracking dogs brought in from British Columbia were out in the biting wind, sniffing for clues in the backyard of the rectory. Munden said the search for Legere was continuing near Newcastle and in Bathurst. ii 0 Refusals to testify frustrate Nfld. inquiry investigators H'YOUR NEWCASTLE, N.B. (CP) -At least one accomplice may be working with Allan Legere, a charismatic killer with persuasive powers police compare to Charles Manson.

Police released an artists drawing of the second man Friday. What we have is a composite of an individual we believe is associated with Allan Legere, RCMP Supt. A1 Rivard told a news conference. We do not have an identity for this individual. Police said forensic evidence has led them to consider Legere, 41, the prime suspect in three brutal murders in the Miramichi region since May.

He is also a suspect in Thursday nights slaying of an elderly priest. Rev. James Smith, 69, of nearby Chatham Head, was viciously beaten and found by parishioners. The killing shocked the towns of Newcastle and Chatham, where many residents now sleep next to guns in houses brightened by floodlights. Its senseless, said retired clergyman Henry McGrath, who attended seminary with the Roman Catholic priest.

He was a well-loved priest, a kind man. I couldnt think of him having an enemy, anyone who would want to do this. A month ago, sisters Donna Alberta Daughney and Linda Lou Daughney, both in their 40s, were beaten to death and their home near downtown Newcastle was set on fire. In late May, An The seven men, who were identified by the first letter of their last name, are among the 26 boys who were interviewed by police in December, 1975 about charges of abuse at the orphanage. At that time, police investigated complaints of physical and sexual abuse by Christian Brothers at Mount Cashel, but never laid charges.

Earlier this year, eight members and former members of the Roman Catholic lay order than runs the orphanage were charged with child abuse. The inquiry has heard testimony from the other 19 residents who were interviewed with one exception a local fishermen who will soon take the stand. Hughes said he isnt considering contempt charges against the three men who ignored their subpoenas. Personally, I dont think wed want to proceed that far if we could avoid it, he said. The 72-year-old retired Ontario judge reserved decision on whether the seven mens police statements should be entered into relations for the Montreal police, said Thursday he had been told that Gosset, 40, has applied to the policemens pension board for early retirement.

Landry said Gosset, who joined the police department in 1971, was to undergo tests Thursday with the pension boards medical experts. The board is an independent body which administers the police pension fund. Its decisions are not binding. Yves Prudhomme, head of the Montreal police union, said Gos-sets application was submitted according to the (labor) contract. Prudhomme refused to say when Gosset applied.

But he said medical experts will have to decide whether Gosset returns to work or retires. The board has three options: The board and the police department could decide Gosset is fit for duty. He would then have to return to work or quit the force. ST. JOHNS, Nfld.

(CP) Investigators for an inquiry into the Mount Cashel orphanage are frustrated by a handful of former residents who refuse to tell their tales of abuse. Weldon Orser, one of two inquiry investigators, testified Friday that three former residents from St. Johns have ignored subpoenas to appear before inquiry nead Samuel Hughes. Another three men cant be contacted directly. They have either told relatives not to reveal where they live, or cant be located.

One man wants to avoid the glare of publicity at all costs. Orser, a slim, soft-spoken man who recently retired from the RCMP after 27 years, said a St. Johns man told investigators to leave his house. He would not give us five minutes to exarpine any documents, said Orser. And two 'attempts to serve a subpoena on him have failed.

Padlocks on his door on both occasions, explained Orser tersely. The Canadian Press The man who may be responsible for four brutal murders around Newcastle, N.B., appears to have launched a perverse challenge to the community which knows and fears him, says a leading criminologist. Colin Gough, a professor at the University of New Brunswick in Fredericton, said in an interview Friday that the beating deaths of four apparent innocents were likely the handiwork of one perverted, very sophisticated individual. Police believe escaped killer Allan Legere is the man responsible for the killings. It seems to me a direct challenge, and also a message to the public that Hey, Im still around, dont rest easy yet very perverted, said Gough.

Probably, hes laughing. evidence with their names deleted to protect their identity. Frank ODea, lawyer for the Congregation of Christian Brothers, said the names should be deleted to respect the mens desire for privacy. Im inclined to agree with you except the appearance of concealment which seems to set scribbling every journalistic pen in the country, said Hughes. I feel I have to make some sort of a balance.

Hughes was referring to several rulings hes recently made to limit public evidence at the inquiry. Earlier in the day, a former resident, Giddeon Preshyon, testified that he told two social workers after he left Mount Cashel that he hated the institution. I didnt want to go back there because I probably would hang myself, said the 29-year-old. Thats what I told them plain and simple they never asked no reasons. Preshyon said he was physically mistreated during his six years at Mount Cashel, from the age of 13.

Prudhomme said Gosset has 18 years seniority and would have to wait seven years before he would be eligible for regular retirement. The board could rule he is unfit for duty as a result of the shooting and was disabled in the line of duty. Gosset could then receive a pension of 80 per cent of his salary indexed for life. Finally, the board could decide he is not fit for duty, but not due to a job-related disability. Gosset could then receive two-thirds of his salary, indexed for life.

According to figures given in the labor arbitrators ruling, Gosset was earning about $40,000 a year at the time of the shooting. Meanwhile, the police department is continuing with its own tests, Landry said. He said Gosset must still undergo a psychiatric test before a recommendation is made on what to do with him. Police chief Alain St. Germain will then make the final decision expected this month.

Gosset says he should receive 80 per cent of nis salary because the incident has left him unfit for duty.
