Messageries Clark Inc.

filed the action Wednesday in Quebec Superior Court. In its statement of claim it acknowledges that Canada Post and its unionized workers have been in the midst of a strike since midnight last Friday but states it has absolutely nothing to do with the dispute. The statement says that since Monday morning, members of the postal workers' union have set up picket lines around the courier company's warehouse and stopped its trucks from entering or exiting the property. Clark says the postal workers repeatedly insult its employees calling them "scabs," and intimidate them by trying to pry the doors of their trucks open or hit them with picket signs. saulted.

In Markham, police were called by the fleeing replacement workers and a security guard who ran from the building and across a field when the mob smashed a glass door to get into the building. Police said strikers had been picketing outside the plant, but became enraged when a truck attempted to leave a nearby parking lot. A man claiming to be a striking postal worker said his group raided the building, but officials from the Canadian Union of Postal Workers were unavailable for comment. "They were telling everyone to get out and searched through everything," said Radivinthar Thomas, a lone security guard at the plant. As one group of workers ransacked the building, others set tires on fire outside and damaged two tractor-trailers loaded with mail that were about to leave.

The trucker was dragged from his rig as the group severed his truck's brake lines, slashed tires and smashed windows. The driver wasn't hurt. No arrests have been made. TORONTO (CP) Violence flared in the postal strike Wednesday as angry postal workers vandalized temporary mail stations near Toronto and Windsor. A mob of about 50 men and women stormed a mail plant in Markham, north of Toronto, threatening the staff and causing about $3,000 damage.

One truck driver was dragged out of his rig as the group smashed windows and slashed the truck's tires and brake lines. The plant was vandalized by the striking workers who burst in as 10 Canada Post employees were working inside, police said. The building had been rented by Canada Post as a temporary storage area for high volume mail. "It (the sorting station) was a secret to us until this happened," said Sgt. Dave Morrison of York Region police.

"By the time we got there they did their deed and were gone." Meanwhile, strikers forced their way into a temporary mail centre in the Windsor-area community of LaSalle, overturning tables, knocking down partitions and damaging mail sorting boxes. Picket captain Rhonda Pegler livered by carriers, a union spokesman said. When a security guard showed up just before the 10 a.m. opening of the centre and colleagues opened the door to let him in, about 10 picketing postal workers rushed the door. No one was seriously hurt, though security guard Chris Hames claimed one guard was as- AA GREAT house in Nulana 3 bdrm $400 reve nue Suite.

Prosecution to use genetic fingerprinting said they trashed the office so Canada Post couldn't get the mail out. "We call it protecting our jobs," she said. The postal workers were angry at Canada Post's decision to have government pension cheques made available at temporary mail centres staffed by replacement workers, rather than be de trial man was wearing a ski mask.

However, Allman said the man who attacked the Flams and the Daughney sisters left his genetic fingerprints at the crime scenes and that is how they will try to convict Legere. "DNA evidence is a very important part of the Crown's case," he told the jury of six men and six women. "In fact, it's the principal part." Found primarily in chromosomes, Allman said DNA forms the genetic code that determines individual characteristics from body size to hair color. With the exception of twins, each individual has a unique pattern. Allman said DNA was extracted from semen found in Nina Flam and the Daughney sisters and compared to the DNA in hair and blood samples from Legere.

He said there's only a minute statistical chance the semen came from anyone other than Legere. For example, Allman said in the case of Linda Daughney, statisticians estimate there's only one chance in 310 million that another male Caucasian would have the same DNA pattern. Legere shouted "hold on" at one point in Allman's monologue, but apart from that he was quiet. With his legs and feet chained to the floor, Legere simply sat and made notes. The prosecution begins its case self-government with Canada on their behalf.

"There is definitely no confidence in Mr. Norton either from the federal government, the provincial government or the Mohawk people of Kahnawake," said Bo Curotte, an organizer of the demonstration. Norton is grand chief of Kah-nawake's Mohawk Council, the elected government of the reserve which was set up in accordance in Legere BURTON, N.B. (CP) A pro secutor in the Allan Legere mur der trial described Wednesday the horrible way in which the four victims died. And Anthony Allman said the new science of genetic fingerprinting will help prove who did it.

The trial of Legere, 43, for the murders of four people on New Brunswick's Miramichi River in 1989 opened with the prosecution outlining its case. Allman, one ot three Crown pro secutors at the trial, said each of the four people "died as the result of a violent assault by another individual." The attacks occurred between May and November of 1989, during the seven months Legere was on the lam after escaping police custody in Moncton, N.B., on May 3, 1989. The four victims Annie lam, 75, Donna Daughney, 45, and her sister, Linda Lou Daughney, 41, and Rev. James Smith, G9 were all savagely beaten. Smith, a Roman Catholic priest.

had 13 broken ribs and stab wounds in addition to head injuries. The three women had been sexually assaulted. Nina Flam, Annies sister-in- law, survived the assault and will be a witness. But Allman told the jury Flam can't make a positive identifica tion of her attacker because the Workers can end strike QUEBEC (CP) If a majority of striking workers go back to their jobs, a strike is legally over, the Quebec Court of Appeal has ruled. The appeal court ruling, released earlier this week, upholds a 1990 judgment by Quebec Superior Court.

The case involved a strike at a sawmill where dissident union members persuaded more than half of the striking workforce to return to their jobs. The company, Daishowa Forest Products Ltd. of Quebec City, declared the strike to be over and resumed operations. The union argued the strike was not over until it said so, regardless of the decision by the members. Lawyer Michel Heroux, representing Daishowa which owns the sawmill at Leduc, said the appeal court's ruling breaks new ground in labor-management relations.

"It recognizes the right of unionized workers to work, over the monopoly of the union," Heroux said in a statement Wednesday. The case goes back to 1989 when 45 union members, out of 77 who were on a legal strike for about a year, went back to work before an agreement was reached on a new union contract. The union, affiliated with the Confederation des syndicats de-mocratiques, charged the company with breaking the labor code by hiring workers who were supposed to be on strike. A labor tribunal sided with the union, but its ruling was overturned by Quebec Superior Court. Constitutional Act of Canada 1982," the petition says.

Norton, who refused to come out of his office to make a statement, is trying to finalize an agenda with the federal government to discuss a new legislative, administrative and financial agreement between the governments of Kahnawake and Canada. Kahnawake is just south of Montreal. ALLAN LEGERE four murder charges today by calling its first witnesses. It's expected to call more than 200 witnesses from all over Canada and the United States. Although genetic fingerprinting has been used successfully in several cases in the United States and Britain, the technique is still in its infancy in Canada.

The Legere trial is considered an important test case for the procedure. Legere is represented by two lawyers, one of whom just joined the case on Wednesday. Legere's main lawyer is Weldon Furlotte of Moncton. His new lawyer is William Kearney, a well-known former Fredericton Crown prosecutor who was dismissed from his job after 13 sex-related charges were brought against him. A judge dismissed the 13 charges against Kearney, saying the provincial attorney general undermined Kearney's right to a fair trial by firing him.

with the Indian Act. The protesters are calling for a return to the traditional Mohawk system of government and do not trust Norton to move in that direction. The term "self-government," they said, represents a federal scheme to get Natives to forfeit their rights. "The elected council was given the mandate in 1979 and 1981 for Iroquois Traditional Government, not self-government within the Angry Mohawks say no to self-government 1 KAHNAWAKE, Que. (CP) Mohawks carrying placards that said "No to self-government" had harsh words on Wednesday for Grand Chief Joe Norton as they protested outside the band council office at the Kahnawake reserve.

The protesters prepared a peti tion signed by more than 600 Kahnawake residents which says Norton and his council must not sign any agreement on negotiations for.
