PL New York (AP) A state judge yesterday dismissed a million-dollar libel suit brought by Dr Linus Pauling against the conservative magazine National Review on the ground that the Supreme court has the balance sharply in favor of the freedom of public Justice Samuel Silverman called his ruling an extension of a 1964 landmark decision by the Supreme court in a case against the New York Times It said a public official collect for libel unless he can establish malice and reckless disregard for the truth A Public Figure Silverman said Pauling had made himself a public figure by his peace activities which led to a Nobel peace prize Pauling had also won the Nobel prize in chemistry The judge said he was not holding that the National Review articles were true or justified One of them called Pauling of the leading fellow and the other implied that he had filed the libel suits to intimidate the press Pauling had added the prestige of his reputation to the causes in which he Silverman said merely hold that by doing so he also limited his legal remedies in any claimed libel of his he added can be deemed another sacrifice that he is making for the things he believes Editor Also Sued Pauling sued the magazine its editor William Buckley jr and its publisher William A Rusher The first of the articles appeared in 1962 after Pauling and others had signed a newspaper advertisement critical of military intervention in Vietnam Silverman said both articles criticized public conduct and motives not his private life He said Pauling had testified that peace had been a dominant interest for 20 years Silverman noted that his efforts to press Iris views on public officials had led to the Nobel peace prize-- underlying policy adopted by the Surpreme court in the New York Times case would seem to favor extending the doctrine of that case at least to a private person who has thrust himself into the vortex of the discussions of a question of pressing public Four Imported Soloists By John Haskins (The Star's Music Editor) The Kansas City Philharmonic brought its 33rd subscription season to a noisy conclusion at the Music Hall last night with a Beethoven program offering the first and the ninth symphonies to an enthused audience that fell far short of filling the house For the choral finale Conductor Hans Sehwieger brought up the chorus of the University of Missouri some 90 voices who regularly sing under the direction of Thomas Mills and imported a quartet of soloists from the East (Mary Munroe soprano Joanna Simon mezzo-soprano Nicholas di Virgilio tenor Malcolm Smith bass) None of the soloists showed to particular advantage positioned behind the orchestra and just before the chorus Air of Strain Apparent An air of strain perhaps due to their positioning was in evidence from Malcolm opening melisma on the word They settled down for their final ensemble effort but there were no joyous sparks struck between beginning and the close The chorus was drilled to the nines responsive to the demanding beat and up to the very end of the piece an agitated Babel of sound they projected their words distinctly That frenzied conclusion with the orchestra blowing and bowing full blast would have been too much for almost any chorus Perhaps the best musical moments of the evening came in the slow variation movement of the Ninth which had a certain eloquence and individual players like bassoonist Michael Spielman gave excellent account of themselves There was hope for the scherzo which began with fine brio but it was not sustained The evening began with a well-routined reading of the Symphony No 1 in Opus 21 It was played without heaviness but with a measure of strength and while it reached no heights it retained respectablility through its four movements Busy Selling Tickets There was a great deal of intermission by-play in the lobbies of Music Hall where the ladies of the Junior association were accepting season renewal reservations from the and passing out carnations for each one received Back in the hall before the second half began John Phillips president of the association made a pitch for renewals from the stage and the ladies worked in the aisles another 10 minutes or so It all made for a very late evening The last chord sounded about 11:40 putting the audience out on the street just in time to meet the
