Judge Armand Dureault ruled both French and English language rights were entrenched in the Manitoba Act of 1870, the act of Parliament wh)ch created the province.

These rights could not be overthrown by subsequent act of the provincial legislature, the judgment said. Judge Dureault's ruling was Montreal debt Bill forces to accept QUEBEC (CP). Montreal must accept $200 million of the billion-dollar Olympic debt or lose its share of the provincial sales tax, the Canadian Press has learned. The pay-or-else order is con in response to an application by Georges Forest, a St. Boniface insurance salesman, who refused to pay a parking ticket last summer because It was written in English only.

Forest noted that the City ot Winnipeg Act calls for bilingual traffic signs and notices in the St Boniface district, which has a substantial French-speaking population. Judge J. S. Walker ordered him to pay the fine, ruling that a parking ticket was part of a court process and therefore subject to the Official Language Act. tained in a bill entitled An Act respecting the City of Montreal, to be tabled shortly in the Quebec national assembly by Guy Tardif minister of municipal Montreal Mayor Jean traffic control communications under instrument flight rules, which apply to commercial aircraft.

Judge Dureault accepted his notice and ruled that Forest may apply for a hearing date, at which time it will be deckled which language will be used. Judge Dureault rejected the argument by Crown attorney David Rampersad that Manitoba should be capable of nullifying the linguistic protections of the Manitoba Act because of general jurisdiction of civil matters assigned to provinces by the British North America Act, Canada's constitution. Drapeau has refused to nite the COO million as part of the Olympic deficit. He told a legislature committee last August: "I've said that we wouldn't pay the $200 million and I repeat that we will not pay the S200 million." Rather than sit back aod accept the $200 million asadeficit, "let's roll up our sleeves and go and get that $200 million," through revenue-raising schemes, Drapeau suggested. Sources in the municipal affairs department said Tuesday the bill will authorize the revenue minister to divert sales tax revenue normally given to Montreal to the payment of the Olympicdebt if the city persists in refusing to recognize its $200 million responsibility.

A spokesman for the revenue department said municipalities as a rule receive an eighth of the provincial sales tax of eight per cent collected within its boundaries. The Quebec public accounts for 1974-1075, the last full fiscal year for which figures are available, showed Montreal got $62,662,293 from the province as "compensation payable to municipalities in lieu of the right to impose a retail sales tax." tensions between leftists and rightists heightened by the abduction last weekend of a leading conservative. More than 200 policemen swept through a Madrid suburb Tuesday night -looking for Antonio Maria de Oriol, whose ultra-leftist kidnappers demanded the release of 15 political prisoners. Apparently no trace of him was found, and the government rejected the kidnappers' demand. In northeast Spain, a special army unit was placed on alert In Barcelona for use If Catalonian nationalists made trouble. The conservative government also ordered police protection for leading Communists, Socialists and Christian Democrats after they received death threats attributed to rightists. Extra security was also ordered for King Juan Carlos and the cabinet. The referendum was the Spanish people's first chance to register their wishes since the death of dictator Francisco Franco 13 months ago. It was a key element in the 38-yeaMld king's plans for an orderly transition to democracy after four decades of dictator ship.

Hie new, freely elected parliament would replace the ultra-conservative Cortes, most of whose members were ap pointed by Franco. Both the left and the ultra- tight opposed the referendum. The leftists urged the voters to abstain because the left did not have a hand In drawing up the proposed reforms and because the government refuses to legalize the Communist party. The diehard Francois ts, calling for "no" votes, feared that elections would benefit the left Premier Adolfo Suarez, In an election-eve telecast, urged the people to support the election proposal and "open the door to roll democracy."
