Times Colonist Friday September 16 2005 A7 Atlantic Canada keeps close watch as Ophelia crawls north HALIFAX (CP) Hurricane watchers in Atlantic Canada are casting a ary eye stHith, carefully tracking the progress of hurricane Ophelia as she slow ly makes her way toward the East Coast. The increased attention is understandable in Nova Scotia, a province still clearing fallen trees and brush blow down two years ago by the destructive pow er of hurricane Juan. But a spokesman for the Canadian Hurricane Centre said Ophelia wasn't in the same league as Juan a Category 2 hurricane that hit Nova Scotia and Prince Edward Island in September 2(K)3. Steve Miller said Ophelia was expected to lose some of her punch by the time she arrived in Nova Scotia on the eekend, but the storm could cause localized flooding, power outages and wind damage. "It's only a Category 1 over the Car-olinas but it's expected to weaken a fair bit before it gets here." Miller said from his office in Dartmouth, N.S.

The storm system is expected to brush the Nova Scotia coast, bringing heavy rains and wind gusts up to 90 kilometres an hour on Saturday. On Sunday, eastern Newfoundland is expected to feel the worst of what a weakening Ophelia has to offer. "We're forecasting the system to come right onto the Burin Peninsula, which would put the Avalon on the right side of the storm, which is the high ind side," said Miller. Brunton agreed the families have a legitimate interest in the appeal, but dismissed their lawyers' claim they have a "distinctive perspective" on Homolka to offer the court. Brunton said their experience in lobbying for the dispositions of the Criminal Code now being applied to Homolka, coupled with the fact that her lawyers are only raising its constitutionality after the fact, opened the door to the parents' limited participation. Tim Danson, who has represented the French and Mahaffy families for 15 years, said he believes they will be satisfied with the voice they have been given, even if it is a smaller one than they'd hoped for.

"The only thing worse than failing is not trying at all," Danson said outside the courtroom. "All the families could ask for was to be heard and to have a fair hearing and we got that. "They feel to not be involved in the process at all would be to abandon their daughters." Homolka's lawyer, Sylvie Bordelais, made no comment as she left court Thursday. But during the proceedings, she objected to the parents' participation on the grounds that what they were asking for amounts to retrying Homolka. "You cannot redo what has already been done," said Bordelais.

"You cannot do indirectly what you cannot do directly." Homolka and her then-husband Paul Bernardo abducted, tortured, raped and murdered Kristen French and Leslie Mahaffy in the early 1990s. Before the full extent of her role in the savage crimes was known, Homolka pleaded guilty to manslaughter in exchange for her testimony against Bernardo, in what became known as the "deal with the devil."
