Richard A. Calhoun, Woodhull Debra D. Coziahr, Suiti Filed Aft objection to a motion to dismiss and strike portions of he petition was filed today in circuit court in Knox County in the case filed on behalf of Rex Shipplett, Louis H. Moon, Dorothy M. Stegall, Harley Morse, Frederick Stegall Jr.

and Mable Swanson against Abingdon School District 217. The suit was filed late last month requesting the court to order a recount of ballots in a May 25 Abingdon referendum at which voters approved a million bond issue to building a new high school. Attorneys on behalf of the plaintiffs later filed a request to amend the suit, to drop the name of Mable Swanson from the list of plaintiffs and to drop the name of one election judge who allegedly campaigned for the issue. Attorneys for the school district Tuesday filed a motion to dismiss the suit and strike portions of the petition alleging that the defendant was incorrectly named in the suit and that some allegations of the suit were irrelevant and drew conclusions. Today's objections to the motion to dismiss contend that the allegations are pertinent and a proper basis for a request for the recount.

The suit contended that the recount should be ordered because some election judges were not of fair character as required by law and that proponents of the issue made false statements in advertising two days before the election. Traffic Accidents Charles E. Thompson, 23, 487 S. Chambers was apparently uninjured Wednesday about 8:30 a.m. when his motorcycle collided with a car near Main and Seminary streets.

Second St. Today's objection contends that advertising stating that the high school was a fire hazard could have materially affected the outcome of the election and that other allegations are pertinent and have been the basis for previous court decisions in similar cases. A hearing has been set for July 25 at 1:30 p.m.
