Whitefield of San Francisco has filed a petition for letters of administration upon the estate of her brother, the late Edwin A. Whitefield, consisting of a blg fruit ranch in the Sunnyside district on Hen Lomond mountain. This is the estate in which Wilfred A. Whitefield, the dead man's brother, asked President Roosevelt to inter fere, claiming that the court and the local lawyers were robbing him right and left. Failing action by the presi dent, Mr.

Whitefield shook the dust of Santa Cruz county from his feet and went back to his home in Mlnne sota last July. Notice has already been given by publication to Whitefield that if he continues to stay away he will be re moved, and Notherton Torchiana, his attorneys, have received word frotn him that he would return and give the reasons for his conduct when the proper time came. NEW OFFICER HAS SEEN SERV ICE IN THE UNITED STATES NAVY. A. I). Houghton was last night fleeted lieutenant in command of Santa Cruz division of the state naval militia, In succession to Captain Morey, now second in command of the state organization. Lieutenant Wllley, who has been temporarily In command of the division, in the absence of a regular commander, will retain his rank of lieutenant, junior grade.

Mr. Houghton, who is an old olllccr of the United States navy, is a comparative new comer to Santa Cruz, hut has quickly become Identified with Urn business Interests of tho town. For four years past ho has had a summer home on the East Cliff, near Capltola, and for tho past year and a half he has been a member of tho Fast Side lumber company, and a permanent resident of Santa Cruz. Mr. Houghton was assistant engineer In tho Boston navy yard for five years and during that time served on the auxiliary cruiser Seminole, and also had charge of fitting out the torpedo boats llahlgren and Craven.

The new commander of the naval militia, accepted the post at the earnest solicitation of Commander Morey, and said to The News this morning that while he Is an extremely busy man and would prefer that someone else he chosen, he would accept and do his part in the upbuilding of the division, so well begun by Commander Morey and Lieut. Wllley. Governor Sanders of Louisiana will appoint a permanent state board of arbitration to handle labor troubles. It will consist of five members, two to be suggested by employers, two by the employes, the four to select the fifth member. K. E. Calvin, general manager of the Southern Pacific company, has filed the railroad's answer to the damage suit of tho Perez heirs for the death of Fred Perez following a collision with a passenger train at the S. P. wharf in July, 1906, for which a suit is brought for $15,000 damages.

The railroad's contention is that had Perez stopped and listened after one train had passed by before venturing on the track in front of another going In the opposite direction, no accident would have resulted. It is claimed that tho whistle was blowing and the bell was ringing on the engine which struck the old fisherman's rig and caused his death. Cassin Lucas appear as attorneys for the railroad.
