HOLIDAY GUTS. AUCTION SAIM. MONDAY EVENING, DECEMBER S81. reference to the statement of Gallagher, his agrees with it in all the material points. He says that Hugh Kelly was very much intoxicated on that night and that Gallagher had drank some but was about half and half." He said Gallagher was considered a quiet, peaeeable man and not disposed to pick a quarrel.

He is a young man, about 25 years of age and unmarried. It is considered that the execution of Gallagher is certain unless by some extraordinary exertions a stay of proceedings and new trial granted. R.R Ourr.bfrlHU(i Coal ilo 10 Liar. em New Haven and Hartford. Six a avenue R. Tan Coitriof Gitxianii AJt bturiif with tsi Condemned, James Gallager, now under sentence of death for the murder of Hugh Kelly, on the morning of the 80th of August last, Is at present confined in the County Jail of Kings County awaiting exeoution. His wife has been allowed by the Sheriff to remain in the cell with him at the earnest request of the prisoner, who desired that she might be allowed to remain with him as it would be company for him.

She has been with him since the day of his sentence, and was absent on that occasion because she was not made aware that her husband was to be sentenced that day. Since his sentence the prisoner has given up all hope of the interposition of the executive. He claims that he did not have a fair trial, and that had the trial not been so hurriedly disposed of he wonld have been able to produce witnesses which would havo shown by their testimony that the assault made by him was done defnse' He has made up his mind to die and says he forgives his enemies and those witnesses who have sworn falsely agaiait him. On Saturday our reporter had an interview with the condemned in his cell. He manifested more feeling than he showed on tho trial, and frequently during the interview gave vent to his feelings in sobs and sighs.

He states the account of the affair to be as follows For soma time previous to the affray I had been out of work, and the week previous had obtained a job of work in 47th street, N. at tho Malleable Iron works. I was thankful to get steady work and started for home to give my wife some money which I had earned. I came over from New York about eleven o'clock on Saturday night the 29th, in company with Mr. Maloy, the foreman of the shop.

Soon after wo came over the ferry I missed him at the corner of Main and Front street, and thinking that he had gone to McMahon's saloon went down there. I there found some of the Main street party and others. I was all alone when I went in. I asked my brother, Patrick Kelly, and Owen Callahan up to the bar to drink, stating to tbe rest that if I had money enough I would ask the whole up. I was not acquainted with the whole of the party.

After I drank I went to the proprietor and told him to make me a stew. He said that the oysters were about done and were not very good. I then called for a sixpence worth of raw oysters which were given to me. After getting them I went to the oyster stand and took up an oyster and took out my knife and was going to open it, when Dan McKinney rose off his chair on which he was sittiDg, between the oyster stand and the bar, and shoved Charles Quinn against me. I turned around and asked Quinn what he shoved against me for.

Dan McKinney then said, "punch the son of a Upon that I got on to the stair to go up and Patrick Kelly came towards me and told me that I had better get out of that as there was going to be a fight. When I got about half way up the stairs the crowd rushed after us calliDg out, "punch the son of a "take the fight out of him," At that time James Higgins came down from the top of the steps and struck me in the back of the head. I got on the side walk when Hugh Kelly caught me by the hair behind, and others got hold of me by the legs and pulled me down on the side walk, if then felt some one have their hands in my pockets. Hugh Kelly and Owen McKinney were on top of me, and the rest some kicking me in the head and beating me as I lay on my face va the side walk, Patrick Kelly pulled them off me and I rose on one knee and struck out right and left with my right hand. I then got up and heard Lewis Gallagher, my brother, calling out for me.

I sprang out into the street so that he might see me, when officer Dan Kelly came up to me and told ma to leave. I went over to the corner of the Franklin house, bnt did not run as Dan Kelly testified to. I did not go more than a block, and when I was arrested and brought back I did not know that any one was stabbed till I was told so by the officer. When I was taken to the station house I did not make use of the expression which Captain King said I did to Kelly. I saw Dau McKinney kneeling over Hugh Kelly, and as I entered the door Ban looked up and said, "Fou big headed son cf a this is your work." I said, 'Tou son of a it was you raised the muss." I forgive the witnesses that have Bwom falsely against mo, and if I bad had an opportunity I could have proven that one of them robbed a hack driver named McClosty of $67, by knock, ing him down in the street and heating him so severely that he had to be taken to the Hospital.

I did not have a fair trial the Judge rushed it through so quick that I did not have an opportunity to call witnesses such as would prove the circumstances of the assault upon me. The District Attorney was determined to convict me, and did not treat mo fairly on the trial He seemed to take a pleasure in convicting me' I have made up my mind to prepare for death, and hope to be forgiven for my sins. I never saw Hugh Kelly in my life to my knowledge WM. COLE, AUCTIONEER. BY PEBD A OOLK Ralks Kooir, o.

Mr. Johnson, City Missionary, Mr. Bulkley, and others. Fieb. Between twelve and one o'clock yesterday afternoon a fire broke out in a three story brick building situated in tho rear of "Warren's gold pen factory, No.

3 Stanton street, occupied in part by Jonathan Warren as a machine and jobbing shop, containing a boiler and engine, and other machinery also in the upper part by Jesse M. Folk as a carpenter shop. Tho building was entirely destroyed. The flames communicated to an adjoining three story frame building situated between the brick building and the gold pen factory, and owned and occu pied by Almon F. Warren as a pencil case fac tory.

This was also destroyed. A frame ehed on the rear of the lot 151 Concord street, aid adjoining the brick building, owned by Tunis (J. Bergen, was also destroyed. The fiie was discovered by John Bose, who was passing at iho time, and saw two little boys coming out of the alley way, who told him there was a fire there. went down and saw the inside of the brick building in flames, and gave the alarm.

The fire is supposed to bave been the work of an Incendiary, as some men have been prowling about the placo recently and were seen to leave the vicinity by an alley way on Concord street, just before the fire. The loss on stock and machinery is as follows Brick building, owned by Jonathan Warren, and stock and machinery also owned by him, $9,000 J. M. Metcalf, residing at Mo. 375 State street, and in the employ of A. 8. Barnes stationers, No. 51 John Btreet, New York, was fatally injured by falling down the rear steps in the building corner of Fulton and Nassau streets.

He was taken to the City Hospital by officers Boyd and Elias, of the First precinct, where he died about half past nine o'clock the same evening. It is supposed that he went up the front stairs, and on reaching the landing walked directly along the passage, under the impression that it continued straight along to tho other flight of steps going up to the third story. At the distance of five feet from the front stairs the landing terminates, and another flight leads down to the back yard. He fell down this flight and was found at the bottom in a state of insensibility, with the lower part of his skull fractured, and blood gushing out of one of his ears. He was immediately taken to the City Hospital, and attended by Drs.

Steeves and Hutchison. When he arrived there he was laboring under epiliptic convulsions, bleeding from the right ear and entirely insensible. After a short time he beoame quiet, and blood commenced gushing from tho nose and both ears. Bespiratioa ceased about ten minutes after 9 o'clock. Externally there appears to be a fracture of the base of the skull.

The Committee appointed 10 nomimte Officers and Director! for this Association, having been instructed to publish there suit of their deliberations previous to the or Election, respectfully pubmit the following report In selecting names to be proposed for the suffrages of members of the Association, the Committee have been more embarrassed by the large number of ihose whose persenal char act' and aUnding in the personal ftttccm, would abundantly guarautee the efficient discharge of the dutieB assigned ihtm, than by any other cireumuiance.

It wonld bave been far eRier to make out a list of thirty or forty gentlemen, than to select from that number the fourteen required to ccnetttute tho first board. Bevond this, it has been the aim ol the Committee, a far a possible, to represent in the management of the Association, various nis incta ot Urn City, and the several leading classes most i nereH ed in the establishment and maintainance or such an InaULution. vis: The youog merchant, clerks, mechanica and professional men of Brooklan. He is visited daily by a Catholic priest and nuns, who administer to his spiritual welfare. He is of opinion that if he had had a fair trial or an opportunity to call witnesses to establish his statement, that he would not have been convicted of murder. Efforts are being made to procure a commutation of his sentence or a stay of proceedings, until a case can be made out for an appeal.
