Ed. Sentinel thirty years since, a book was published in New York, by Dr. Cheever, on Capital Punishment. In that work, the author gave a full and complete scriptural ar. gument of the authority and binding force of tha death penalty upon' the murderer, a law of God at all times, In all and among the people of the earth.

He also gave the warning note ot tbe evils that would follow, If this Divine Law should be left to fell Into disuse. About the same time, tbe writer of this attended a Lyceum Lecture in Massachusetts, where he who would Hang the Bible," gave a lecture on Capital and Labor. This man, with an unbounded ambition, and full of worldly wisdom, was then laying the corner-stone for bis future aggrandizement. Here we are abut np to tbe death penalty as the only penlsbinent of murder. Life and likerty are Ood given, according to our Declaration of Independent, which I aeod not stop to prove, la a Christian principle also. And It is at our porli to stretch forth our band against life, or the liberty, of any man without the authority of his Maker. How dangerous it la to deprive men of liberty without tbe authority of God, let the war of the late rebellion tnawer.

God ha, given authority to take tbe lire of the murderer, but has aiMolutely forbidden punishing him in any other way. Ye shall take satisfaction for the lire of a murderer. You must do with him what his Creator or you have no authority to do anything. You have no right lo imprison' a convicted murderer In the way of punishment for a longer or shorter time. God has nowhere given It.

My life, my liberty, are not my own. They do not belong lo any man, or any number of men, and I can only alienate tbem to him who gave them. But perhaps I shall here be told that the foregoing and similar Old Testament rquirements are not. binding now. I freely admit, that typical, and ceremonial which pointed out a promised Savior those things which in the lime, of this ignorance God winked at, and those that were' permitted the for the hardness of their hearts, are passed away.

He was strictly an honorable man in every thing pertaining to business and fl ranee, and his many friends will regret his untimely ueatn. no was born in Leroy, New York, in 1826 On the 26th of July, he arrived overland from Missouri. He then posessed a fine education, and bad already given evidence of brilliant talents. He commenced the practice of law in Monterey in 1850, and in a short time became so popular tbat be was elected District Attorney. After occupying this position for one term be was sent to the Assembly from Monterey in 1854, was ro-electod in 1855, and served in tbe State Senate from that County in 1856-57.

He ac quired a reputation for superior Legislative ability, combined with strict Integrity. Persistent in his opposition to all political chicanery, and bold in denouncing all attempts to pass thieving bills, he won the confidence of all honest men. Mr. Ashley leaves a wife and five children, tbe eldest daughter being the wife of Daniel O'Connell, the well-known poet and journalist. I fear, how-over, that many of them, if they find it docs not favor their theory, will be ready to say, as tbe lato Mr.

Greeley once said, in a conversation on the subject of capital ptinishccent, with a friend of the writer, "II the Bible says bang a man, I say hang the Bible." Cain was the first murderer; and it is argued that as God did not immediately put him to death, or permit men to do it, therefore the infliction of the death penalty on tbe murderer is not agreeable to the will of tbo Creator. But the case of Cain proves too much for the opposers of capital punishment, and therefore proves not hing at all. It proves just as clearly that the murderer should not be imprisoned, or interfered with by man in any way, as it does that he should not be put to death. This Is more than tbe opposition claim. So far as I know, tbey all favqr the imprisonment of tbe murderer for a longer or shorter time.

Wo read that the earth was filled with violence- be fore the flood. Men failing properly to punish murder, porbaps misinterpreting God's dealing with Cain, It greatly increased. Therefore God destroyed the race of Cain, Lantech, and all other violent men, with tho waters of tbe deluge. What he did do was to deliver tho law from the false interpretation and improper execution of it by the Jews. lu the xiii, of Romans we aro told the properly authorized civil officer the minister of God that he beareth not the sword In vain that he is a revenger, to execute wrath upon him that doeth evil. The sword is tbe emblem of death. If he is not to put the murderer to death bo certainly bears it iu vain. If tbe murderer is only to bo imprisoned, tho civil officer', insignia should have boon a cord or chain, not a sword.

He a revenger, to execute wrath. Whose wrath bis own? No. The people's No. But God's, because bis power is from God. I conclude, therefore, that theefTort to abolish capital punishment is a mistaken and greatly misplaced philanthropy that tbe general course of tbe press in regard to mordr and the murderer is demoralizing; that cou-viction would not beany (lore certain were the law changed from capital punishment to imprisonment for life; tbat the decrease of murder in any case has not been owing to the repeal of tbo death penalty, but to otber causes that tiie great txass of writers on fundamental law have all been in favor of capitally punishing murderers; tbat God's providential dealing wltb Cain is not an examplo to us that the laws given to Noah and Moses in regard to murder, and not only not repeated, but really re-enaoted by Christ and enforced by bis Apostles, are still binding on the civil authority and that properly constituted civil government in taking tbe life of tbe murderer does it by tbe direct authority of GJ.
