B. Staples, of Monroe county, yesterday, In an opinion received by the court, denied the motion to strike off the compulsory non suit In the case of Mrs. Kate Grant against the borough of Dickson City. Mrs. Grant, sought damages for alleged injuries received by falling through a bridge on Grier street in the borough.

The case was tried before Judge Staples sitting in common pleas court at the last term. The case was non suited on the ground that the plaintiff had failed to prove that the street where the accident was alleged to have occurred was ever accepted by the borough. For the same reason the Judge refuses to strike off the nonsuit. Vosburg Dawson represented Mrs. Grant.

James E. Burr defended the borough. In the case of the Dime Deposit and Discount bank against James J. Hea ley, Judge E. C.
