A.

Seymour, and recorded in the office of Recorder of McKean County, in D. B. Vol. 83 at page 400 thence east along the north line of Cole Avenue, ninety-one and seven tenths (91.7) feet, more or less; thence north in line almost parallel with Bennett twenty-four and eight tenths (24.8) feet; more or less; thence west and parallel with. Kimball; thence south along said land fifty feet (50 ft.) to the northwest corner of land of John Larson; thence east along the north line of said land seventy-five feet to the place of beginning.

Containing 3750 square feet of land, more or less, improved and having thereon erected a two-story frame dwelling house and being the same premises conveyed by Arthur O. Erieson, Guardian, and others, to the said Isaac M. Faxstein, by deed dated June 15, 1917, and recorded in the recorder's office of McKean County, in deed Book Vol. 175, page 202. Mullin Woods Attys, for Plaintiff. 9 The defendants' interest in and to PARCEL No. 1 land, All that situate in certain the piece Borough or of parcel Kane, of County of McKean and State of Pennsylvania, being part of subdivision No. 382, of Warrant No. 2389, bounded and described as follows: Beginning at a post marking the northeast corner of Oak Street and Smith Avenue (25 feet from the center line of Oak Street); thence along the east line of Smith Avenue, (25 feet from the center line thereof) north six hundred and seventy-two and four tenths feet to a post; thence east six hundred and fifty-five and eight tenths feet to a post in the west line of a twenty-foot alley thence along the west line of said alley, south five hundred twenty-two and twentyfive one hundredths feet, to a post in the north line of Oak street; thence along said north line of Oak street feet from the center line thereof) west two hundred forty-five and three tenths feet to a post in the west line of Elk Avenue; thence along the west line of Elk Avenue, south one hundred fifty and fiften one-hundredths feet to a post, marking the northwest corner of Elk Avenue and Oak Street; thence, along said Oak Street (25 feet from the center thereof) west four hundred ten and five-tenths feet to a post, the place of beginning.

2389, Sub. 382: Beginning at a point in the east line of the glass factory site 45.5 feet south from the northeast corner of the above mentioned lot, said point being also 183.2 feet eastward from the southeast corner of the storage building, said right of way to be 2 rods wide and to be 16 1-2 feet each side of the following described line; thence first in an eastwardly direction curving to the right with a radius of 465.46 feet, a distance of 217 feet to a point in the center of said railroad spur, also being the west line of Tionesta Avenue; thence on the same course crossing Tionesta Avenue, a distance of 50.5 feet to a point in the center of spur and being in the east line of Tionesta avenue, also being the west line of the Moynahan property. Containing 22-100 acres, more or less, to be used as right of way from the P. E. R.

That certain strip of land hereinafter described, located upon subdivision 382 of Warrant 2369 in the Borough of Kane, County of McKean and State of Pennsylvania, better known and designated upon a plan of said sub-division made August 25, 1868 by Mordecai N. 41. Being a right of way twenty (20) feet wide (ten feet on each side of center line of said right of way as surveyed by M. J. Dill) running from the easterly side of said lot on a slight curve to the westerly side of said lot. This conveyance is expressly made and accepted under and subject to all and singular the exceptions, reservations, conditions, restrictions, leases, agreements and rights of entry, mentioned in the deed.

All that certain piece, parcel or lot of land situate in Wetmore Township, McKean County and State of Pennsylvania part of Warrant Nos. 3175 and 3210 bounded and described as follows: Beginning at a driven iron bar in the southwest line of the right of way of the Kane Railroad being sixty feet distant from the southwest line of the right of way of the Philadelphia Erie Railroad and thirty-eight feet west of the center line of the Highland Road and likewise fifteen feet southwest of the center line of the switch of the Penna. Window Glass thence parallel to the center line of said switch, and fifteen feet distant therefrom by the northeast line of a reserve roadway fifty feet wide heretofore dedicated to the public use a roadway and known as Pennsylvania Avenue, north seventy-seven degrees and forty-five minutes west six hundred and twenty-five feet 77 deg.

45 min W. 625 ft.) to a post marking an angle in said line of a roadway and thence a further distance along said line of roadway north forty-two degrees fifty minutes, west five hundred min. W. eighty-nine 589.3 ft.) 3-10 ft. (N.

42 deg. 5 to a driven iron bar marking another angle in said roadway known as Pennsylvania Avenue and also the west corner of the land herein described and the said iron bar being also one thousand four hundred and twenty-one 9-10 ft. (1,421.9 ft) due south from the northeast corner Pine and Pennsylvania Avenue Kane Borough; thence north degrees ten minutes east, four hundred and fifty-two and eight-tenths feet (N. 59 deg. 10 min.

E. 452.8 ft.) to a post on the southwest line of the right of way of the Kane Railroad (60 feet wide); thence by the same fo.lowing the various courses and distances thereof in a southeastwardly direction about one thousand and thirty-eight feet to the place of beginning, as surveyed by T. L. Kane in June, the needle reading at a variation of four degrees and two minutes (4 deg. 2 containing seven acres of land, more or less; but Excepting and reserving all that certain piece, parcel and tract bounded and described as follows: ning at a driven iron bar in the south west line of the right of way of the Kane Railroad Company sixty (60) feet distant from the southwest line of the right of way of the Philadelphia Erie Railroad Company, now the Pennsylvania Railroad Company, and thirty-eight (38) feet west of the center line of the Highland road, and being the east end or point of the lands conveyed by Elizabeth D.

Kane to the Pennsylvania Window Glass Company, by Deed dated June 7, 1899, and recorded in the recorder's office of McKean County in Deed Book Vol. 106, page 484; thence north seventy-seven degrees forty-five minutes west (N. 77 deg. 45 min. along the south line of land conveyed by said deed, a tance of one hundred sixty (160) feet to a point; thence north to a point in the southwest line of the right-of-way of said Kane Railroad Company; thence southeasterly along the said southwest line of said right-of-way of the Kane Railroad Company to a point the place of beginning on which is erected a gas station and being the east end or part of the said premises conveyed by the said Elizabeth D.

Kane to the said Pennsylvania WinGlass Company by deed aforesaid. PARCEL NO. 5. All that certain piece, parcel or lot of land situate in Wetmore Township, McKean County, State of Pennsylvania, part of Warrant No. 3175: Beginning at a point on the north east line of lands conveyed by Elizabeth D.

Kane to the Pennsylvania dow Glass Company, a former tion, by deed dated June 17th, 1899, and duly recorded in the recorder's office of said McKean County, about five hundred sixty-five feet northwest of the east corner of the place of beginning therein described; thence south forty-two degrees fifty minutes east thirty-five feet along the northeast wall of the cutting room and flattening house building to the east corner thereof; thence along the southeast of said building south forty-seven degrees ten minutes west seven feet to the line of right of way of the Kane Railroad Company; thence along the said line of right of way northwesterly to the place of beginning. PARCEL NO. 6 All that certain piece of land situate in Wetmore Township, in the County of McKean, State of Pennsylvania, bounded and described as follows: Beginning at a point in the southern right of way of the Kane Railroad sixty-nine feet westward along the said right of way line from the said Highland road; thence forth seventy-five degrees fifteen minutes west five hundred eighty four feet to a point; thence in a northwesterly direction by a curve to the right with a radius of four hundred twenty feet, two hundred ninety four feet, to a point; thence north thirty eight degrees forty eight minutes three hundred fifty eight feet to a point; thence north one degrees twelve minutes east twenty feet to a point; thence south thirty eight degrees forty eight minutes east three hundred fifty eight feet to a point; thence in a southeasterly direction by a curve to the left with a radius of four hundred feet two hundred seventy nine feet to a point; thence south seventy five degrees fifteen minutes east three hundred sev. enty feet to a point; thence in a northwesterly direction by a curve to the right with a radius of four hundred twenty feet forty one feet to a point; thence north fifty three degrees nineteen minutes west two hundred forty seven feet to a point; thence north thirty six degrees forty one minutes east twenty feet to a point; thence south fifty three degrees nineteen minutes east two hundred forty seven feet to a point; thence in a southeasterly direction by a curve to the left with a radius of four hundred feet one hundred forty two feet to a point in the southern right of way line of the Kane Railroad; thence in an eastern direction along the said right of way line of the said Kane Railroad by a curve to the left with a radius of one thousand three hundred eighty one feet fifty feet to the place of beginning, containing of an acre more or less. PARCEL NO.

7 All that certain lot or piece of ground situate in Wetmore Township, McKean County, State of Pennsylvanla, Warrant No. 3210, bounded and described as follows: Beginning at a point in the west line of Pennsylvania Avenue marking the north corner of land conveyed to the Kane Electric Light and Power Company by deed dated May 8, 1907; thence by said land of the Kane Electric Light Power Company south 47 deg. 10 min. west two hundred fifty feet; thence parallel to Pennsylvania Avenue north 42 deg. 50 min.

150 feet; thence at right angles thereto north 47 deg. 10 min. E. two hundred fifty feet; to a west line of Pennsylvania avenue; thence by the west line of Pennsylas vania Avenue (25 min. from the center line thereof) south 42 deg.

50 min. East 150 feet to the place of beginning. Containing 37,500 square feet more or less. PARCEL NO. 8 All that certain piece, parcel and tract of land situate and being in the Township of Wetmore, County of Kean, State of Pennsylvania, part 50 Warrant No.

3175, bounded and scribed as follows: All the part and parcel, with a Railroad Track and switches therein, excepted and reserved in and out of the premises described in that certain deed from the Pennsylvania Window Glass Co. dated Dec. 23, 1920, to the Mountain Gas of Company, reference thereto being had, in the part, and parcel so excepted and reserved will more fully and at large appear in the following words and figures: "Excepting and reserving therefrom and thereout to the said grantor, its successors and assigns, such part and parcel of said tract of land as is now occupied by Railroad Sidings and switches of the Grantor, and a strip four feet wide, measured at right angles, on each side of the Rails there of." PARCEL, NO. singular 9. the factories, lehrs, ovens, warehouses.

offices, structures, erections, buildings, improvements, tenements, hereditaments, additions, accretions, ways, alleys, right of way, railroad tracks; sidings, easements, rights, liberties, privileges, franchises, fixtures and machinery, whether affixed to any of said premises not, engines, boilers, water rights, wells, gas lines, gas wells, electric power plants, gas producing plants, machine shops, tools, apparatus, equipment and other implements and appurtenances whatsoever belonging to or in any wise appertaining to the premises hereinabove described; and the reversions and remainders of every part and parce. thereof; and all of the estate, right, interest, property, claim and demand whatsoever as well in law as in equity of the Interstate Window Glass Corporation in and to the same. Parcels Nos. 1, 2 and 3 hereinabove described are subject to the following reservations contained in the special warranty deed dated March 20, 1914 from Kane Window Glass Company to A. H.

Gaffney and recorded in McKean County, Pennsylvania in Deed Book 168, page 81 on May 2, 1914: "Excepting and reserving therefrom to the party of the first part its successors or assigns, the right to erect and operate on the land first above described, a plant for the manufacture of gasoline, should the said party of the first part, its successors or assigns, desire to erect such a plant; provided, however, that no building shall be erected for such purpose, under the rights hereby reserved, nearer than one hundred (100) feet to any building now on the premises hereinbefore mentioned and described, or that may hereafter be erected on the location now occupied by any building thereon, and provided, turther, that if the party of the first part, its successors or assigns, shall not erect on the said lot of land, under the rights hereby reserved, within two (2) years from the date hereof, a plant for the manufacture of gasoline, or if said party of the first part, its successors or assigns, at any time in the future, after having erected such plant, shall abandon such plant as a factory for the manufacture of gasoline, then; and in either such event, the right hereinbefore reserved to erect and maintain such plant, shall thereupon cease and determine; and provided, further, that during such time as any portion of the above described premises shall be occupied or used by said party of the first its successors or assigns, by the erection or maintenance of a plant for the manufacture of gasoline, the said party of the first part, its successors or assigns, shall pay all taxes levied and assessed against the land so used or occupied by the party of the first part, its successors or assigns. Reserving, also, unto the party of the first part, its successors or assigns, the right to use, jointly with the party of the second part, the present railroad switch, running from the Pennsylvania Railroad to the factory now erected on said premises, or part thereof, for all purposes connected with the erection or operation of said contemplated gasline plant, and to extend the said switch to such site as may hereafter be selected for the erection and maintenance of a gasoline plant, as hereinabove provided, on the payment of a pro rata per car of the cost and maintenance and upkeep of so much of said switch as shall be so jointly used." "Also reserving unto the party of the first part, its successors or assigns, the right to use water from said premises to operate the gasoline plant hereinabove mentioned."
