i i 3 N.Y. Cigarette Smokers Can't Avoid Use Tax JAMESTOWN, N.Y. The dilemma of the cigarette smoker faced with higher prices because of a five cent state tax boost cannot be legally solved by slipping over the border. Smokers are warned they are subject to a 10 cents per pack "use tax" if they bring back two or more packs from, nearby Pennsylvania where prices are lower. Area residents could save 50 cents or more a carton by buying cigarettes in Pennsylvania, less than 10 miles away, but a little known N.

Y. S. "use tax" makes it a losing proposition. The "use" tax has been enforced since 1939 according to the State Department of Taxation and Finance. Neighboring state taxes range from five to eight cents a pack and the federal government gets an additional eight cents a pack in all states.

Checks in the amount of $680 bounced on the Mutual 'Building and Loan Association and $580 on the Marquette Building and Loan and as nearlv as the two officials can figure out this is what, hap pened: A woman, apparently searched the mortgage books at the courthouse until she came up with a complete run down on mortgage information on a particular home and from which building and loan the money had been She went to the association office, said she was representing the owner of the property who had an $80 house payment due. She then offered a $680 check to the Mutual and completed the transaction, walking out the door with $600 in "change." The method of operation at Marquette was the same. Only the amount of the check was different. The checks were drawn on a Cleveland bank but they came back marked "no account." Savings and loans and also consumer discount companies which might have mortgages recorded at the courthouse were being alerted.

According to Joseph Kreczkowski, social security district manager in DuBois, the leaflet was prepared especially for th parents of mentally retarded children and is available free of charge from any social securily district office. By mid 1964, leaflet states, at least half of the estimated 114,000 retarded adult receiving social security payments were over age 115. Som 3 were over f.ge The leaflet explains that a child may become eligible for social security 'tjenefiis. when one of his parents receive social security retirement or disability benefits, or when one of his pirop.ts But if the child is disab'e at the time he reaches 18, his ben? ''s continue for as long as he J. disabled which may toe for lite.

Also explained is the fact that slight or mederate retardation may not mean tint a child will be considered disabled. A person is considered disabled under the rocial security law only if he has an impairment which prevents, him from doing an substantial gainiul work. In many cases, Mr. Kreczkowski stated, a person who has been dis abled since childhood becomes elig ible for social security benefits in middl? age or later when one of his parents who has worked under so cial security retires, becomes disabled or dies. Mr.

1 Kreczkowski said that most parents find comfort in the knowledge, that their children are pro gressing steadily toward maturity and economic self reliance. He pointed out that for the parents of mentally retarded children there is anxiety worry which increases with concern over the support and care of the children. The social security. law has special importance to these parents, he because it can lead to monthly payments and help free them from these worries. To obtain a free copy of the leaflet "Social Security: What It Means Parents of A Mentally Retarded Child," Mr.

Kreczkowski said, get in touch with the social security office at DuBois by telephone, letter, or personal visit.
