The program is meant for first-time of-' fenders, who are not required to admit guilt and must prove they are likely to respond to rehabilitation. Battaglia, who could not be reached for comment Wednesday, was admitted into PTI on June 10, 1993.

In January 1995, the comT mittee recommended to the Disciplinary Review Board that Battaglia be temporarily suspended, said Johnson. "Basically, they committee members try the same case in "a disciplinary hearing rather than a criminal court," Johnson said. The review board, which reports directly to the Supreme Court; concurred and Battaglia was suspended effective May 22, 1995, Johnson said. "Howard Stern Show" broke through the barrier of acceptable radio with a bawdy mixture of gay-bashing, crude sex jokes, and generally gross humor. Hackensack was selected to stand in for Hartford, a city known mainly as the bland capital of the insurance industry.

Hackensack had given Stern and company permission to film July 8, but the day came and went, and America's favorite outlaw DJ didn't materialize. Gene Duffy, Hackensack's director of cultural affairs, said rain forced cancellation of the shoot, but no one from Northern Lights, the film's production company, called that day to say that Stern wouldn't make it. Angry at being stood up, Hackensack officials refused to let Stern and his crew shoot the following day. By Wednesday, the plot took another turn. Duffy said an agreement was worked out after Northern Lights asked the New Jersey Motion Picture Commission to intervene.

It was the commission that had recommended Hackensack in the first place. "I wouldn't exactly call it an appeal," Duffy said. "It was more like the commission worked as an intermediary." Hackensack agreed to let Stern come back but only if he filmed the scene on Sunday morning, when Main Street is as quiet as dead air on the radio. In this case, the controversy is on Main Street in Hacken-sack, where Stern was supposed to be on July 8 to film a scene for the movie, "Private Parts," based on his best-selling auto-! biography. But Stern was a no-show that day, and after that, the city of Hackensack had turned a cold shoulder to one of the hottest stars in entertainment. Until Wednesday that is, when the city agreed to let Stern come back to Main Street this Sunday morning to film the oft-delayed scene.

The state Supreme Court last year ordered Joseph J. Battaglia suspended following a disciplinary hearing before a district ethics committee in Bergen County. Battaglia was admitted to the bar in 1981, said Dave Johnson, director of the Office of Attorney Ethics for the New Jersey Supreme Court.

Battaglia was not formally reinstated until the high court issued an order Monday. Battaglia was charged with conspiracy to possess cocaine in 1992 during a drug sweep through Clifton, Passaic, Paterson, and Haledon.
