We ilnd that the Police Ollloer, Paul Smith, is wearing a Board of Health badge, und stated that he represented the Hoard of Health as lt agent' or Inspector, and this has also been corroborated by Doctor Cooper. Mr. Plnk-limn, President of the Hoard of Health lnted that he had nothing to do with any appointment or any of the workings us fur us the physicians In Iwllel uere concerned, but the evidence of Doctor Hoffman In applying by telephone for blank certificates shows that he (Doctor Hoffman) was Informed by someone representing the Board of Health front the Board of Health office that the Iwllel matter was nil In the hands of Doctor Cooper, and that he was the ojie to see, and further find that Paul Smith as agent of the Board of Health and Police Officer receives $70 per month from the Police Department, and $30 per month from Doctor Cooper, and as the agent of the Board of Health serves without pay as far as Your Commute can ascertain, but Is nevertheless clothed with all the powers of the Hoard of Health.

From this evidence It would appear that the president of the Board of Health Ik reckless In his statements, does not know when he tnnkes an appointment or know about any particular rules as to the appointment of physicians under the Hoard of Health or, he may have a convenient memory. (2) By who or whom nre such examinations made? Your Committee find that the exa minations tnnde In Iwllel are made by one physician only. Doctor C. B. Coop er.

(3) What charges are made for such examinations? And what Is the amount collected per day, week, month or year? And what disposition is made of the money so collected? Your committee find that Doctor Cooper charges $1 per week for each woman examined, and also find that there are at the present time about stated by Doctor Cooper to be 128, and stated by Paul Smith to be 129 women at present examined each week, but your committee find that In some cases only three examinations are made per month. If four examinations are made say on the basis of 129 women per week, we find that Doctor Cooper col lects about $512 per month per month, but If only three examinations are made we find thnt he collects about $3S1 per month, or on an average about $150 per month, This revenue so collected your committee flods goes to Doctor Cooper for his own personal use and benefit. Although In the early part of such examinations Doctor Cooper acted as a Sanitary Police Commissioner appointed as such by the High Sheriff, we fall to find where any moneys collected by him, as such, have ever been turned Into the government as a government realization. (4) Are such prostitutes obliged to live In any one particular portion of Iwllel? If not, have not such prostitutes been ordered In the near future to live In one particular portion of Iwllel? And If so, by whom ordered and who are the owner or owners of such particular portion of Iwllel? Your committee; find that the High Sheriff of the Territory, through his agents, has ordered nil of such women that are found In different jiarts of the city, and also in some portions of Iwllel, to move to one particular part as follows on the muknl side of the Iwllel rice mill, and on the Ewa side of tho Iwllel road. From further investigations we find that the rules and regulations as laid down by the High Sheriff requiring these unfortunate women to live in the one particular portion of Iwllel hereinbefore referred to Is, In the Judgment of your committee, unwarranted for the following reasons: In the section so set apart, rooms rent at from six to eight dollars per month, while across the road on the Walklkl side of Iwllel road, rooms rent for two and a half dollars per month, and a little further up the road, rooms can be had at from one and a half dollars to two dollars per month, the owners of which are not able to rent the same even at that price.

Your committee sees no reason why the High Sheriff should so discriminate In favor of one person In Iwllel to the disadvantage of another, and more so on account of the fact that the portion so laid out has not been used so extensively for the Immoral purpose of these women as the premises on the Walklkl side of the Iwllel road, and also a little further up the road which he wishes to close up. Your committee cannot believe that this Is done for nny moral reason as thore are a few families living on the Ewa side adjoining the particular portion so set out, while on the Wnlklkl side of tho road there Is nothing nd-jolnlng oxcept vacant lands, the Fertilizer Words, tho Oil Tanks and the United States corral, which is hardly over now used nnd by no families whatever, Any nnd all such rules and regulations, In the opinion of Your committee should be Imtnedlatoly rescinded by the High Sheriff, page one.) The whole of Iwllel tnakal nf the Oahtt prison ha been umI far Die pun of prostitution for mim time past, and Your Committee cammt sett except for itemonal reasons, why the I Unit Sheriff, or any one else, should try to force any of these people Into any one particular portion nnd especially In a iHiitlon where the High Sheriff, from the evidence produced, Is personally Interested, owning quite a piece of property In this small corner set apart by him upon which Is located the offices of Doctor Cooper, as well as being Interested In the Fidelity Insurance Company, as a director, which comiiany owns three large buildings containing, according to the testimony of Ogata, about forty-eight rooms, which brought, to the order of the present High Sheriff, less than one dollar per room per month. In regard to who the examinations are made by your committee feels that the examinations as at present carried on by Doctor Cooper should be stopped for the following reasons: According to the statement of Doctor Hoffman. It takes from fifteen to thirty minutes to make one proper examination. Doctor Judd states that it would take twenty minutes or more to make one proper examination.

Say It took the least time mentioned, namely, fifteen minutes, it would tuke to examine forty-five women which Doctor Cooper states he examines In from two lo two and one half hours, elevon hours and flftten minutes. Thfs will give you some Idea as to the manner In which these examinations are being at present made. Dootor Cooper- examines forty-five In say from two to two and one-half hours, this is at the rate of from 18 to 22 on hour, or on an average of one In about every three minutes. Doctor Cooper's own statement shows that It takes him from five to ten minutes In ordinary cases, and In extraordinary cases from fifteen to twenty minutes to make proper examination. Your comm'ttee makes these comparisons to show the results of his testimony If you scrutinize it carefully.

Besides this Doctor Cooper testified be fore Your Committee that he had given these women the benefit of a free clinic at Iwllel, which surely must take some of his time. When any such examinations show disease the card usually given her Is taken up and she Is simply allowed to go on her own nccount with Intructlons not to ply her trade until she Is well and a new card Issued to her. In the meantime she can go where she pleases 'n the city so long as she makes dally call at Iwllel or brings a certificate that she Is being attended by some practicing physician, and your committee agrees with the statement made, by Doctor Cooper when he testified that these women could easily spread disease because they were out of control. In fact these examinations as at present carried on nre, in the opinion of your committee, simply a farce, the taking of money without giving value received, and the means of. the Territory spending $70 a month to round up these women in order that one particular doctor can collect about 450 per months from them, of which the only outlay that we can see from the evidence produced Is office rent and $30 a month that Doctor Cooper gives the representative of the Police Department at Iwllel for services rendered when such police officer is In the pay of the government of the Territory and this, In the opinion of your committee, should not be tolerated.

Sir: We, the undersigned, a majority of the Special Committee, to which was referred Senate Resolution No, 40, providing for the appointment of a Special Committee of Five to Investigate under what rules and regulations the prostitutes at Iwllel are controlled, beg leave to report as follows: 1. What rules and regulations have been niade, or made or used for the examinations and control of prostitutes at present at Iwllel, Honolulu? We find that rules and regulations have been laid down by the Police Department whereby all prostitutes, at Iwllel, are compelled to be examined once a week, and have certificates Issued to them from a licensed physician, to be able to ply their trade In Iwllel and if they do not 'secure these certificates they are prevented from doing business. Your Committee finds that a policeman, who Is In the employ of the Police Department, Is employed by Dr. Cooper to keep his private books (which he does after his hours) under a salary of $30 a month. In addition to these duties he Js delegated by the High Sheriff to the special district of Iwllel.

We And also, that police officer Paul Smith wears a badge of the Board of Health, and stated that he represented the Board of Health as an Agent or Inspector, This also was corroborated by Dr. Cooper that Paul Smith was an Agent of the Board of Health serving without pay. Papl Smith is In receipt of a monthly salary of $70 from the Po lice Department, and as an Agent of the Board of Health serves without pay, as far as wo can ascertain. 2. By whom are such examinations made? We find that the examinations made In Iwllel are made by Dr.

Cooper charges $1 per week for each woman examined, and also find that at the present time there are about 128 women, as stated by Dr. Cooper, and 129 as stated by Paul Smith. These women are examined each week, but in some cases only three examinations have been made per month. In case any of these wo men nre sick they are treated, free of charge, by Dr. Cooper until they have fully recovered.

The amounts collected for these various examinations, by Dr. Cooper, would average about $450 per month, which Is the doctor's personal realization as the result of his private practice, but Doctor Cooper states that his expenses per month are about $150, and the difference would be the value of the "practice to Dr. Cooper. 4. Are the prostitutes obliged to live In any one particular portion In Iwllel; if not, have not such prostitues been told, in the near future, to live In a particular portion of Iwllel, and if so, by whose order and who are the owners of such particular portion of Iwllel? We find that the High Sheriff of the Territory, through his agents, have ordered all of such women that are found In different parts of the city and also In some portions of Iwllel, to move to that portion of Iwllel which Is ma-kal of the Iwllel rice mill, and on the Ewa side of the Iwllel road.

We. find that that particular portion of Iwllel where the prostitutes ure now located is owned by the Fidelity Insurance Company, Limited, nnd Is now leased to a Japanese named Ogata by misrepresenting the object for which he wished to obtain this lease from the Waterhouse Trust Company, the agents of the Fidelity Insurance Company, Limited. From the testimony, which this committee has taken, we find no reason to censure any one for the conditions existing in Iwllel. The matter has been, so far as we have been able to find out, conducted, by those who had the matter In hand, for the best Interests of the community and we find no occasion to censure those who have had the matter In charge, realizing that they have had a difficult matter to contend with. There are only two ways in dealing with this question, one Is, to properly regulate, and the other Is, to entirely abolish.

As the resolution, under which our investigation 1b carried on, does not require us to go into this question as to whether It Is to be abolished or properly regulated we will not discuss the question. We find that the regulations that have been enforced has had the effect of removing the evil from the resident portions of the city to a large extent, and has been the means of preventing the Increase of certain diseases, apd has removed It from the sight of the community, Respectfully submitted, Minority report signed HAYSELDEN, GANDALL, HEWITT, Committee. OLANI HALE NAMED AGAIN Should the Senate concur In a joint resolution passed by the House yesterday afternoon the name of tho Capitol building, the old royal palace, will be changed back to Its old designation of "Iolanl Hale." The subject was brought up by the following letter which was read tn the House: "Hon. E. A.
