Federal Court Justice Marcel Joyal said a painting of a British Columbia mountain that hangs in a Kingston penitentiary's dining room belongs to the jail, not to the man who painted it while a prisoner. Though artist John Hawley estimated the picture's value at $12,000 to $15,000, Joyal said he'll have to be content with what he was paid as a prisoner: $6 a day. Hawley painted Mount Whymper, which is in Kootenay National Park, while serving a long sentence for armed robbery. He was released in 1987 and has since been running a commercial art and design studio in Toronto.

After his release, Haw ley sought compensation for his painting. But Joyal said he could not claim it belonged to him. The artist says he spent 500 hours painting it. His current rate is $60 an hour, so he estimates the painting's value at $30,000. But in his suit he gave it a street value of $12,000 to $15,000 and sought punitive damages as well.
