It was in this regard that Stewart sought to introduce new evidence, but the appeal court ruled that he failed to establish a necessary basis on which the judges could exercise their discretion to receive it. Stewart also claimed there was mis-direction or non-direction in the judge's charge to the jury. He claimed the trial judge wrongly limited the cross-examination of Miss Trigiani on the statement made to her regarding his injuries, and that the judge referred to the self-defence theory as conjecture. Appeal court judges said, that the word "conjecture" was not used and held that the trial judge's charge to the jury was fair and comprehensive and nothing of substance was admitted to the prejudice of Stewart.

Mr. Justice E. B. Bull, who wrote the judgment of the court, said that the appellant's submissions about the charge to the jury were without substance. Mr.

Justice M. M. McFar-lane and Mr. Justice J. P-Taggart agreed.

Dr. Glen Gold Stewart, 44, failed Thursday in his apjieal against conviction in the noncapital murder of a Bible camp caretaker near Bam-field in October, 1970. In a unanimous decision, B.C. Appeal Court judges rejected Stewart's appeal and a bid to call new evidence concerning the death of Gordon Adrian Kralt, 23, whose body was found in bush about 600 yards from the camp building. Kralt was a temporary caretaker at the camp and according to evidence Stewart, who was living on a 35-foot ketch, applied for the job of caretaker on a permanent basis.

Stewart had been living on the boat with a woman named Maria Trifiiani, who testified at the trial, that she paid living expenses. On Oct. 27, Stewart and Miss Trigiani registered at a Victoria motel and on Friday, Oct. 30, Stewart went to Barn-field. Kralt was last seen alive that night and, according to evidence, Stewart arrived at the Victoria motel Oct.
