District Attorney Kavanaugh asked. "Mr. Knauf and myself talked with Wells on July 14 relative to making a statement.

At that time Wells said If we would allow him to see Violet Wells he would be willing to make a confession." Violet Wells, the state maintains, was the motive for the slaylngs. Alfred Wells killed Mr, and Mrs. Raymond Wells, the prosecution contends, because he believes they persuaded Violet to leave his home where she had been living with him. He assertedly sought revenge on Miss Destree because he believed Miss Wells, his half-sister, was staying with the former's parents. Sheriff Shay said he told Wells that Miss Wells was not in San Bernardino but that he would send for her.

"On Saturday morning, July 19, Violet Wells and myself went to the Isolation cell In the county Jail where she talked with him," the officer said. "Part of the time they were talking In low voices and I didn't hear all that was said, WELLS 'DIDN'T CARE' "I did hear Wells said that no doubt he would see the gas chamber but that he didn't care he did not fear death. He said he wanted Violet Wells to forgive him." As usual, whenever a witness testifies something to which Wells does not agree, he cursed the sheriff in a stage whisper. "While Violet and Wells were talking, they got mad and Wells said to Violet, 'the with you, I'm not going to tell you anything'," the sheriff continued. "Then Wells produced a sharpened spoon and It was taken away from him." "Approximately half an hour or an hour later, I received a call from the jailer.

Mr. Knauf and I went to the jail and at that time, Wells told us that if we would get Violet Wells so she could be In the same room with him he would make a statement. The sheriff said Wells was wearing handcuffs and a safety belt to which the cuffs were fastened. He said that Wells was not "under any pressure" to talk. Gilbert testified that an autopsy disclosed that Jean Wells died of wounds from two bullet holes. He said both lungs collapsed after the chest cavity had been pierced on both sides. Miss Destree also was shot two times, both times in the back, the physician said. During the physician's testimony Wells was furtively wiping tears from his eyes and suddenly broke into a hard cry. "About that time Lars Bjorkman, a neighbor, drove up and I got into his car and we turned around and drove to the end of the road, stopped the car and got out. I hollered I don't remember Just what and someone answered, 'here I It sounded like a woman's voice. From the voice we could tell the woman was south of us. We drove south, then stopped and hollered again. The voice answered, 'here I said Mr.

Bellah. "We walked over to the wash and found a woman sprawled out on the ground and rocks. I asked her what was the matter." "You had some conversation with the girl," Mr. Knauf broke In. "and during the conversation did the girl ever say anything about her expectation to live or die?" Unless the state could prove that Miss Destree believed she was dying, her conversation could not have been introduced into evidence.

Bellah gave the "surprise" testimony which the state Indicated Thursday it would introduce. "Yes, the girl did say something about her expectation to die," Mr. Bellah answered Mr. Knauf. "She said, 'don't bother with me, I'm done for, go find the baby, I tried to bring it with me but I couldn't get it to leave Its mother.
