You can't keep a good syndicator down 'doomed' for very long RIVATE REAL ESTATE syndicators, tax supposedly law, not only "doomed" appear under to be the very nex much alive, but they may, in some cases, be busier than ever. "I know we're looking at more properties in more markets nationwide than we have in a long time," states Clifton Harrison, chairman of the Board of Harrison Freedom Associates, a Dallas-bused real estate investment banking firm and a private syndicator. Harrison, who is general partner of such New York properties as 680 Fifth 400 and 310 Madison 42 W. 48th St. and the Barbizon Hotel, admits that while the new tax law "has altered the strategy and direction" of the investment game, it hasn't changed its intensity.

"If anything, it's made us more active and aggressive in seeking out suitable real estate investment around the country," he says. "The big differences has not been in the hunt, but in the type of game we're now hunting." The real estate executive whose syndication expertise has helped produce a billion-dollar portfolio that includes not only the aforementioned Manhattan buildings but such holdings as the Stamford Sheraton Hotel in Connecticut, the Brazilian Court Resolution to preserve Francis Greenburger and Philip Pilevsky, sponsors of conversions at Tudor City, and the Trust for Public Land recently announced that a resolution has been reached to insure the permanent preservation of Tudor City's parks and that a local board of directors was elected on April 29 to manage the parks. The two parks, situated between 42d St. and Second were the subject of a major open-space controversy which began more than 15 years ago and involved more than eight years of litigation by Tudor City tenants. In a complicated transaction, the parks, valued in excess of $40 million, were first donated to the Trust for Public Land (TPL), a national land-conservation organization.

"Since this requirement eliminates a lot of properties that would have previously been considered, we've compensated for this loss by significantly expanding our marketplace," says Harrison, who notes that his firm is actively looking for real estate acquisitions today not only in New York, but in Boston, Washington, D.C., Southern California and many other sectors of the United States. And while acknowledging that the new tax law has caused a realignment in some real estate values, he also believes it has forced real estate investment firms to look for other avenues of opportunity and that, as a result, it has triggered a wave of creativity and expansion within the real estate marketplace. His company, for example, is now aggressively seeking out institutional joint ventures, creating debt equity offerings through traditional Wall Street firms, and working closely with mutual funds in the creation of no-load limited partnerships.

Tudor City parks and then transferred title to a newly formed nonprofit organization, Tudor City Greens Inc. The long and stormy debate over the parks' ultimate use began in 1972, when Tudor City was purchased by Helmsley-Spear which had plans to develop two apartment towers over the parks. Public opposition to the proposed housing development soon erupted, attracting the attention of city officials. In an attempt to resolve the conflict, the City Planning Commission and Board of Estimate adopted a plan to create a special zoning district restricting park use to recreational purposes. The plan proposed to compensate Helmsley by transferring the development rights from the parks to other parcels in midtown Manhattan.
