In an intriguing case revealed in Manhattan Surrogate's Court yesterday, a judge will have to decide which of two wills one drawn in 1977 and the other in 1979 filed by Malvena Hendrickson, who lived in an E. 65th St townhouse, is legally binding.

The 1977 will to be probated names Albany lawyers John DeGraff Sr. and John Holt-Harris Jr. as executors of the will and recipients of most of the Hendrickson estate. But a two-page will drawn Sept 28, 1979, and filed in Surrogate's Court in Manhattan last week, names Hendrickson's housekeeper, Margo Lest, as heir to jewelry of unspecified value, a $750,000 townhouse at 126 E. 65th St, and all other money left after $45,000 is paid to nine other persons.
