In letter yesterday to Kent L. Barwkkv chairman of the Preservation Commission, Goldin urged the commission- to bring his proposal before the Board of Estimate. Sheldon Fried roan, the attorney for the seminary, said that its board of directors has opposed the landmark designation because once a building is landmarked, "you have to go to the Preservation Commission whenever you. want to do any building that would affect it" He said that Goldin's proposal would be studied with great interest and he was pleased that the controller is- showing interest in the problem, la his letter to Barwick, Goldin noted that the commission, under its present administrative code, cannot fashion such a solution as his on its own, but urged the members to contact the City Planning Commission and the Board of Standards and Appeals to "develop such an approach," A spokesman for the Landmarks Preservation Commission said yesterday that the commission is not empowered by law to "fashion" proposals with other agencies, but to rule on the worthiness of designations, as far as their esthetic, architectural and historic worth.

WARE OF the growing back-fj lash against the tendmarking iAd of church-owned property, Controller Harrison J. Goldia ha come up with a proposal to aSev the Jewish Museum to build an apartment house "beyond existing zoning" restrictions" next to an upper East Side building that is awaiting final designation as a landmark. At issue is the Louis E. Warburg Mansion, at Fifth Ave. and 82d St, which is owned by the Jewish Museum and the Jewish Theological Seminary.

The mansion was designated a landmark in November by the Landmarks Preservation Commission. That designation is now being considered by the Board of Estimate, which has final approval in landmar-king cases. The mansion's owners oppose landmark designation. The mansion is linked to the List Pavilion, a non-landmarked building that the seminary wants to demolish, to make way for a 25-story luxury apartment building. Under the seminary's plan, the new apartment would be connected to the mansion and would extend over it Under Goldin's proposal, the suasion would be landmarked "expressly and solely" on the condition that the -owners be permitted to develop the List Pavilion in accordance with two guidelines: That the height of any building constructed on the List Pavilion site be restricted to a level consistent with that of immediately adjacent apartment houses on Fifth Ave.
