At the same time, MacMahon vacated Babitt's order of April 7 declaring the Overmyer Co. bankrupt, but left former Deputy Attorney General Harold Tyler Jr. as custodial receiver pending further orders from the bankruptcy court. Daniel Overmyer, owner of the warehouse chain, was ousted from the company by Babitt, who installed Robert Herzog as receiver.

Hidalgo was driving near his home when two men in anothe rear forced him to stop and grabbed him as he emerged from the car, the police said.
