If this one is a witch hunt, then every investigation into violations of the law is a witch hunt." Docking's press secretary, James Shaffer, also had issued a statement saying that Malloy's report to the governor had indicated Justice Department attorneys questions were "obviously political in scope." Malloy was questioned by the jury about a party for Kansas Democrats given in a downtown Topeka hotel before, the 1972 general election. Roth said the law prohibits him from disclosing evidence taken by the grand jury but said, "Our investigation is absolutely properly motivated. We don't really care who it might affect:" Roth, a Republican, said the investigation was started over a year ago by the FBI "at the request of the police chief of Kansas City, to determine the involvement of men in prostitution and massage parlors and other matters." He said the Organized Oime Strike Force of the federal government has been involved in the probe.

"To date, we. have had indicted the principal operator of a prostitution ring, a police officer who was on the force at the time and a former police officer. The operator of the prostitution ring and the former police officer both pleaded guilty to charges, and the other policeman is awaiting trial." Of allegations that the grand jury probe might be "ptriitically motivated," Roth replied: "That is completely and una- dulterably false, unfair, erroneous and ridiculous. "I can state that the principal people conducting the investigation are totally unfamiliar with Kansas politics and, I'm sure, are totally unconcerned where the chips may fall." Doug Lewis, executive secretary of the Kansas Republican party, said implications in the statements by Malloy and Shaffer that the probe is politically inspired, "is foolish." "I think to characterize a federal grand jury investigation as a 'witch hunt' indicates two things: it casts aspersions on the. American judicial process and, apparently, the governor's off ice is extremely and perhaps rightly so," said Lewis. "I can only conclude that information damaging either to the governor personally, or to his administration may result from the grand jury investigation, based on their reaction."
