Can cabby hack it on his pay? Sue to block Times Sq. hotel Owners of the midtown Piccadilly Hotel, who have refused to sell their property to make way for the $280 million luxury Portman Hotel, are suing to block its construction. The suit, filed in Manhattan Supreme Court, could jeopardize Koch administration plans to use the hotel as a focal point for Times Square urban renewal.

The suit charges that the city illegally granted tax exemptions and other incentives to builder John Portman and it seeks to block the city from condemning the Piccadilly property at 227 W. 45th St. The planned 52-story, Portman would replace three legitimate theaters, a movie theater and the 53-year-old Piccadilly Hotel. Members of Actors Equity have protested the planned razing of the theaters, and owners of the Piccadilly say the destruction of the $30-a-night hotel would deprive tourists of inexpensive hotel rooms. -Katharine Schaffer DEATH NOTICES -Thomas.

Second mortgage from an industry credit union that agrees to finance the balance at a "prime" rate of close to over 10 years- $18,000. Monthly payment, about $600. Total monthly payments on the notes, car payments and all required insurance almost $2,000. Says costs are overstated "For the first five years," Silleg told me, "you're not going to be left with that much for yourself. If you're going to get started in this business, with the price of gasoline and insurance, you desperately need this (fare) increase." But what about the driver who made a killing and bought a medallion in 1972 for $13,000 when the market was depressed? One owner-driver said yesterday: "I think the owners are overstating their costs.

I doubt that any cash business reports all its earnings. I don't belong to a radio My gas costs $17 a shift. I do all right. I think a fare increase is enough. "I take a lot of cabs myself," he said.

"I think $22 from Manhattan to Kennedy Airport is too much to ask for." BURNS- Gerald. On March 11, 1980. Beloved husband of Paulina. Loving son of the late Francis Jannette. Reposing at WILLIAM E.

Interment, St. Charles Cemetery. BURNS- Gerald. (Continued from page 5) that a cab medallion is equity, a property that will hold its value in the city's closed marketplace. A cabby's dream is to own his taxi someday -be his own boss and work whenever and wherever he wishes.

Ways to beat the system, The industry position i is that if a driver is totally honest, doesn't hustle passengers and reports his income, then rising costs merit a fare increase. Otherwise, there are more than enough easy ways to beat the system and rake in enough unreported cash to make an increase unnecessary. Silleg brought my head back down out of the clouds when he itemized the current cost sheet on his package deal. The medallion plus car and insurance cost $63,000. Financing and other costs are extra.

At the end of the five to 10 year financing program I would have spent today's interest rates: My in cash. First mortgage on the medallion from Citibank or Bankers maximum, on a five-year note.
