SECTION XV. In constructing and operating the works the company shall be liable to any d.miajre arising from injury to the property ot persons of the city or citizen, and shall save the city harmless from any damages therelrom. The fire hydrants rented by the city shall be used for no other purpose than hereinbefore provided; and to insure this, it shall be a misdemeanor for any person not authorized by the citj to open them. SECTION XVII.

Within 20 days of the passage of this ordinance the Said C. A. Lamb and H. E. Keeler shall file with the city, their acceptance of the same, which acceptance duly acknowledged before some officer authorized to administer oaths, shall have the effect of a contract between the city and said company.

SECTION xxv. It is hereby agreed by and between the said C. A. Lamb and H. E.

Keeler their successors and assigns, and the city of Minneapolis, that in the event it be deemed necessary in the construction or extension of the said water works, to issue first mortgage bonds upon the said water works property or extensions either on all that so much of the hydrant rental to be paid by the city of Minneapolis under the provisions of this ordinance as will fully pay the interest of such bonds, shall be paid the holders of such bonds by their trustees semi-annually, on the first days of January and July of each year until said bonds are paid, and that the balance of the hydrant rental, the city of Minneapolis agrees to pay to said C. A. Lamb and H. E. Keeler, their successors and assigns.

It being understood that the hydrant rental which the city of Minneapolis agrees to pay to the said C. A. Lamb and H. E. Keeler, their successors and assigns, for fire protection or so much of said amount as shall be necessary to cpay the interest on such bonds shall be set aside and paid to the trustee of such bonds, and by him used exclusively, and only for the payment cf interest upon said bonds when and so long as the game shall become due and payable.

Keeler, their successors and assigns, shall in no case bond said water works property or extensions, either or all for more than the' actual cost of said water works property or extensions. SECTION xxvi. A sufficient tax shall be levied and collected annually upon all taxable property upon the assessment rolls of the city subject to taxation, to meet the payments under this ordinance as they may respectively mature during the existence of any contract for public fire service, which tax shall be irrepealable from and after the passage of this ordinance, and in case the city shall be authorized to levy a special tax for such purposes, such tax shall be annually levied and the proceeds thereof shall be kept as a special fund to be known as the Hydrant Fund, and shall be irrevocable and exclusively devoted to the payment of hydrant rentals under this ordinance and shall not be otherwise employed, except that any excess of said tax in any one year over the amount necessary to pay rentals for such year, may be used for any purpose that the said city council shall direct. SECTION XXVII. This ordinance shall take effect and be in force from and after its publication in the official papers.

E. Keeler, ot Chicago, 111 to construct, operate and maintain water works in the city of Minneapolis, Kansas. Bp it ordained by the mayor and councilmen ol the city of Minneapolis: SECTION I. That Charles A. Lamb and II.

IS Keeler, of Chicago, 111., be and they are hereby authorized, subject to the limitations herein, or by law provided, to construct, maintain anil operate water works, in or adjacent to the eity' of Minneapolis, Ottawa county, Kansas. To lay pipes for the carrying or distribution of water, in any of the streets, avenues, alleys, lanes or public grounds of the city, with all necessary and proper buildings, wells, conducts, or other me.ins of obtaining water supply, with all necessary machinery and attachments required to sivply the city and inhabitants thereof with water, and for this purpose mav enter upon any street, avenue, alley, lane, bridge or public ground under the control of the city, to take up any pavement or sidewalk thereon and make such excavations as may be necessary for the laying of such pipe and attachments, provided that such use of such grounds, be made with the least practicable inconvenience to the inhabitants of said city; that such excavations be guarded by barricades wherever necessary, aud lighted at night, and that such sidewalk, pavement or excavations, be replaced bv and at the expense of the water works company in as good condition as before, aud with the least practicable delay. SECTION II. The rights and privileges herein granted to continue for a term or period of twenty years from and after the passage of this ordinance except as herein-after provided. SECTION III.

Said works to be constructed on the direct supply system. SECTION IV. The pipe system will consist of approximately 1,600 feet of 10 inch pipe, 2,500 feet of 8 inch pipe, 12,600 feet of 6 inch pipe, 4,500 feet of 4 inch pipe, with 50 Ludlow hydrants. When so laid and completed the amount of pipe and number of hydrants shall be known as the original pipe system. SECTION v.

For fire protection the works shall have the ability to throw six streams at one time from six different hydrants, through 200 feet of 2 inch hose and one inch ring nozzle, to a height of 100 feet perpendicularly or 133 feet horizontally in still air, and the works shall be constantly in readiness to answer a call tc this eflect, except that for purposes of practice, the calls shall not bo more than one hour in one week. SECTION VI. The provisions of capacity for fire protection above stated shall at all times be over and above the amount of water required for other purposes. SECTION VII.
