Fischer said this week that for a conditional use permit indicates the applicant "has confidence" he can obtain a license.

If the coning commission refuses to grant the permit, the license seeker can appeal to the state department of liquor control. Some members of the commission feel that Winfrey would be reluctant to do this, however, because this would mean his application is opposed by a large segment of the community and would "stir up trouble." Another possible barrier tp Winfrey's sought-for license comes in the form of report that Winfrey's hotel is located within HI feet of the Second Baptist Church, and this would automatically proMMt Mm 'from obtaining a license. If mis is correct, Winfrey's only recourse would' be to obtain a waiver from the church invalidating the legal prohibition. Winfrey and his attorney Fred Waldock said they have heard nothing to the effect that the hotel is this close to the church, and they decline comment on other facets of the license negotiations.
