MARCH 13, 2002 ANNOUNCEMENTS- Obituaries PENNINGTON, Edythe Louise On March 10, 2002, Mrs. Louise Pennington passed away at the age of 80 years. She is survived by her two sons, William (Margery) Ross and their son, Kevin (Colleen) of St. Albert, Alberta, Bryan (Lill) and their daughter, Kristina of Leduc, Alberta. Louise has five great-grandchildren whom she loved dearly, Ryan, Tyler, T.J., Shelise and Darren Jr.

Her sister, Alice lives in Markham, Ontario. She was predeceased by her husband, Ken in 1994; two grandsons, Murray and Darren in 1997. Respecting her wishes, there will be no funeral or memorial service. If friends so desire, memorial donations can be made to the Alberta Lung Association, Box 4500, Station Edmonton, Alberta T6E 6K2; or to a charity of choice. The love, compassion, wisdom and understanding that Louise shared in her own "special way" will remain with family and friends forever.

Howard McBride Westlawn 484-5500 PROUDLEY, Albert E. September 15, 1908 March 10, 2002 Albert Proudley passed away in the Wainwright Auxiliary Hospital on March 10, 2002. Predeceased was his first wife of 33 years, Gladys 1972; and second wife, Lola of 15 years in 1987. To remember him is his only child, Melba and Clare Clemmer of Wainwright. Born in England, Albert moved to Canada at a very young age. While working in the coal mines in Drumheller, Albert met Gladys and married in 1935. In 1940, Albert joined the military and was sent to Europe to serve his country. Upon his return, he reunited with Gladys and Melba in Alder Flats. Albert loved to fish and was an avid gardener.

Albert later moved to Edmonton and then to Wainwright. He was admitted to the Wainwright Auxiliary Hospital in 1999 where he resided until his passing. There will be no service by Albert's request. May he rest in peace. -286509 SCHILLER, Arnold Arnie passed away peacefully March 9, 2002.

Frances was born on March 21, 1948 in Bonnyville, AB.

She received her schooling in Fort Kent, AB and then attended the University of Alberta in Edmonton where she received de her Bachelor of Education degree. Frances then began a teaching career with the Calgary Catholic Board working in the primary grades at Holy Cross School and St. Vincent de Paul School. She loved teaching and enjoyed working with her students. Travel was Frances' other love.

She traveled extensively throughout Europe and the United States. In 1981, Frances was diagnosed as having a brain tumor. Resulting brain damage rendered Frances unable to care for herself. She became a resident of the Dr. Vernon Fanning Centre in 1987 where she was very well cared for by a wonderful dedicated staff to whom her family will be forever grateful.

The family also is thankful for Gloria, Frances' caregiver for then past several years, who dedicated many hours to enhancing Frances' quality of life. Frances leaves to mourn her loving mother, Katie Shalka of Fort Kent, AB; a sister, Eileen (John) Leeds of Calgary, AB; and a brother, Kenneth Shalka of Fort Kent, AB. Frances is sadly missed by her two nieces, Diane (Rod) Orr of Edmonton, Brenda Leeds (Bob) Binder of Belmont, CA; and her nephew, Michael Leeds of Calgary, AB. -055339 Arbitration breeds mistrust, experts say Government's approach seen as undermining meaningful negotiations DUNCAN THORNE Journal Staff Writer EDMONTON The province's tight control over arbitration with teachers will make public employees mistrustful but likely has public support, says a labour-relations specialist. "The government is saying, 'Not only will we not tolerate the withdrawal of services by certain employees, we'll determine and set the terms of the said Allen Ponak, a professor a at the University of Calgary's management faculty. "It really reduces bargaining to a fairly hollow exercise." The province's Education Services Settlement Act will tell arbitrators they must consider salary issues only and must not impose settlements that make school boards run deficits. The approach effectively undermines teachers' rights to meaningful negotiation, he said.

Saville wins judgment in curling league lawsuit High-tech entrepreneur paid $100,000 to buy local franchise GORDON KENT Legal Affairs Writer EDMONTON The Men With Lawsuits have swept their opponents in a legal battle sparked by a failed attempt to start a North American professional curling league. Wealthy high-tech entrepreneur Bruce Saville paid about $100,000 through two companies he ran in 1996 to buy and operate the Edmonton Freez franchise in Curling International, according to court documents. He also had an option for a second franchise in Toronto.

The new league, promoted by Edmonton Oilers co-founder "Wild" Bill Hunter, was the brainchild of former national curling champion Ed Lukowich and Vancouver businessman Merv Bodnarchuk, but it barely got off the ground and Saville never received his money back. Saville sued, claiming in one affidavit that Bodnarchuk has a history of problems with securities commissions in Alberta and British Columbia. In a decision released Tuesday, a judicial official ruled Bodnarchuk must repay the whole amount owed to Basa Systems Group Inc. and Dalgran Systems Group plus interest. "The plaintiffs were to get franchises in a curling league which was to get up and sliding, that is, be operational," wrote Court of Queen's Bench master Michael Funduk.

"That never happened, so there was no performance by It wasn't supposed to happen that way. A confidential franchise owners' manual describes curling as a TV-friendly sport. with a growing, well-heeled audience. There would be eight teams to start, four in Canada and four in the United States, but in the end only Saville and Bodnarchuk bought franchises. Bodnarchuk apparently dreamed of becoming a player like hockey's Mario Lemieux.

He planned to be on his Anaheim Earthquakes team with Lukowich, already a curling partner, and, two other Canadian champions Randy Ferby and Pat Ryan. The men did play together in other competitions. In an affidavit sworn last October, Bodnarchuk- banned from the B.C. stock market for 15 years in 1997 after being convicted of more than 50 securities offences- said he has invested more than $400,000 promoting Curling International. "I believe it is still viable and has a lot of potential for success." His statement of defence insists money was needed to organize the league.

Any refunds that may be owed must come from Curling International a company incorporated in Nevada, and not from individuals involved, it says. Curling International held its inaugural bonspiel that fall. Hunter resigned from the league a short time later to pursue other interests. The two Saville companies cancelled their Edmonton franchise and the Toronto option in March 1997 and filed the lawsuit three months later. Stadium wheelchair policy slammed Journal Staff EDMONTON A disabled advocacy group says City Hall bungled a chance to make Commonwealth Stadium more accessible to wheelchair users.

The city is set to start $1.6 million worth of renovations to the stadium, using money from the 2001 World Championships in Athletics legacy fund. It will go toward building concessions on the west concourse in time for the next football season. "We're going to try and look at some accessibility, if we can," said city manager Al Maurer of the planned renovations to the city-owned stadium. He said funding was approved by the legacy board specifically for concessions. Russ Norton of the Canadian Paraplegic Association said the stadium needs more extensive renovations to make it welcoming for wheelchair users. The transportation and public works committee asked city staff to report back on the problems facing wheelchair users at the stadium, costs and ways to pay for them.
