freedom of choice plan of school pupil assignment In a seven page opinion issued Tuesday Alcrhigc said the plan for the five public schools had not worked to elimi nate racial segregation in the overwhelmingly black educa tional system and even sug gested the county might con sider a neighborhood school concept He added however he didn't think this would work either in the county where the 1969 70 school enrollment includ ed 1551 blacks 159 Indians and 1G7 whites County officials were ordered to file within 30 days a new plan for a unitary school system that eliminate racial segregation At the time he approved the freedom of choice plan Alcr higc said he felt it would' lead to the of the segre gated system But he indicated at a Alarch hearing when black plaintiffs contended the plan had been administered to en courage racial segregation that he was prepared to reverse his earlier opinion In the previous order approv ing freedom of choice he said he sincerely felt the school board plan result in con formity with the constitutional Merhige said in his Tuesday opinion it would have had it been oper ated as contemplated 'Unfortunately there is no true freedom of choice where all citizens arc not treated equally or where the schools for one reason or another are unequal either in their facilities curricula blatant and obvious ad mitted discrimination in this in stance leads the court to the necessary' conclusion that the school plan as oper ated heretoiore is violative ot the Because of the make up however Alcrhige admitted it seemed to him situation existed inevitably there will be some all black.
