discovered evidence chiefly that of a girl of sixteen who virtually admitt ed that she had prejured herself at the trial Being of this mind and unwilling to send a man to his grave when there was a doubt of his guilt Beale was told by Judge Bailey that he would have to spend nlnety nln years in jail when he came back for i esentence which usually follows a supreme court decision This of course is another way of saying life imprisonment That was last July and the prosecuting attorney In con junction with the Attorney Gener office took Issue with the legal ity of this changed decision and in stituted mandamus proceedings be fore the West Virginia Supreme Court their objective being to com pel Judge Bailey to re impose the death penalty Answering the writ Judge BaUey went before the Supreme Court Tues day a week ago and argued his own cate showing the court In detail his reason for believing tieaie io guiltless and pointing out the ceptlonally trying circumstance signed to High
