Charles Owen, who was Mrs. Agnes Ornor's chief counsel in the five triaiS she has had on the charge of poisoning her daughter, Lilli'-, was arraigned for trial on a charge of attempt at sub- orination of perjury, before a jury in the 34 th district court Wednesday morning. He said he was in the Orner case. He said that if I would testify in the Orner case he would give me $50. He said all I would have to do would be to get on the stand and say that man. by the name of Dee came to the drug store and I sold him arsenic, but at first did not want I went to Van Horn. I do not know who sent for me.

I saw Mr. Owen there. He asked me what I was doing there. Says He Was $10. gave me $10.

Two gold pieces. He he ould give me the rest of the money at Van Horn. I did not know Lee. I had not sold a man like that, poison. I guess Mr.

Owen knew Leading Questions Asked. Questions were then put to the witness in an effort to bring out that he had consented to go to Van Horn and testify, for the purpose of the defendant; that he knew that a dictagraph had been placed in the room where Lhe conversation was alleged to have taken place and that he had been instructed to answer to all Owen said. The witness answered yes to all of the questions. The City Directory were men from the outskirts of the edition on sale at the International county and from Loving county. Large crowds are attending the trial. Leo Roddy, constable, was the first witness introduced by the state. He told of four officers approaching two Mexicans in the bright moonlight. One Mexican, he said, staggered as if drunk.

Moorehead stepped ahead of his companions and the Mexican who staggered, shot him before a word had been spoken. Roddy said he followed the shooter half a mile, firing eight times. He found the overcoat that the fugitive dropped, with bullet hole in the right side. The Mexican shot four or five times as he ran. Roddv stated that Moorehead had grrested the defendant on drunken sprees before, but the evidence was ruled out as hearsay.

The accused appears indifferent to the proceedings. The state rested at 2:30 after examining sheriff Tom Harrison, Dr. Jim Camp and C. N. McCoy.

Harrison repeated the story of constable Roddy. Dr. Camp described the wound as being in the left side of nose and necessarily fatal. McCoy stated that pistol was tight in the scabbard when the body was moved. District attorney W.

P. Brady then took the stand and introduced a confession taken at Midland the day after the killing. due the confession reads. Subia being sworn, states: I shot T. Y.

Moorehead last night at Pecos. I thought they were going to kill me. I wTas with Juan Salinas. I thought they were going to put us in jail. I knew Moorehead when he came up The state then rested.
