NOTICE PIXIE BEAUTY LOUNGE BIGLERVILLE HAS A NEW PHONE NUMBER; 677-7328 McSherrystown plans to sue Adams County for approximately $2,008 it claims it is owed for rental and utility payments on a magistrate's office. Plans to file the lawsuit were outlined at a meeting of the McSherrystown borough council Monday night. The town officials claim the county terminated a lease for an office for a magistrate in McSherrystown. The county stopped paying for the office in McSherrystown when it moved the office to Bon- neauviile. At Monday night's meeting council authorized especiallv appointed Solicitor G.

Steven McKonley to "pursue the legal proceedings against Adams County for the breach of -its with the borough." The borough asks a total of S1.85U in rent and an additional $466 in utility and maintenance all of which were accumulated after the county terminated its'lease agreement for the McSherrystown area ijpagisterial office last February. 'Borough officials contend that, the lease was illegally terminated by the county and that is therefore liable for rent and other expenses until the contracted expiration date of December 31. The county commissioners, however, argue that the realignment of the county's magisterial districts by the Adams County court effectively abolished the former McSherrystown area district and that the countv was therefore within its rights to abolish the lease agreement. Council was tojd that Borough Solicitor John W. Phillips has informed the bonding company for the regional sewer project that McSherrystown still intends to oppose any efforts to designate an individual, or lead, municipality to act as authority over the proposed sewage plant.

In his letter to Richard B. Wood, of Rhoads. Sinon and Hendershoi. of Harrisburg. Phillips indicated that the borough "would be derelict in their duties to future generations of McSherrystown citizens and to "future borough councils if they were to concede their desire for a regional sewer authority here at the inception stage." Phillips touid not say what will happen if Hanover and Conewago Township, both of which have supported the lead municipality concept, and McSherryttown cannot finally agree on the issue of the controlling authority.

"Then trouble." the attorney said after the meeting. McSherrjstown. he said, could not be" forced to cooperate against its will as long as a final agreement has yet to be drawn up and at- company has paid the death benefits of Rodney Poist and Charles Hartlaub. two company members who died last month. The bureau said Tuesday that an estimated 385.000 were out of work last month, up from 336.000 in July. The estimates were on a survey of about 3.100 households.
