PAGE NINE Democracy in India Facing Tough Test In Gandhi Case By PHIL NEWSOM UPI News Amlyst To the troubles which normally beset India have now been added the uncertainties concerning the future of Prime Minister Mrs. Indira Gandhi and what is to follow if she is ousted from office. Sought By Officers STATE COLLEGE, Pa. (UPI) Police today sought to locate an 87-year-old man who left a nursing home four days ago and was believed trying to hitchhike to California. Police said Vance Bortner left the Parkwest Manor Nursing Home Wednesday night and was seen the following day at a gas station on U.S. 322 six miles west of here. He told the station attendant he was broke and beading for California.

Forty-five volunteer firemen, assisted by a state police helicopter, searched nearby woods Thursday and Friday but found no clues to Bortner's whereabouts. Authorities said Bortner, a central Pennslvania native, was nearly blind without his glasses, which he left behind in the nursing home. Bortner, with light balding was wearing black slacks, a white shirt and a tan summer jacket Indian development and alleviating perennial Indian poverty as the United States. And it also may be said no other nation has taken as much verbal abuse from Mrs. Gandhi.

Yet, from whatever other ills India may suffer, it remains the world's largest democracy. And for that, as the political figure towering above all others in India, Mrs. Gandhi must be given most of the credit And as Communist totalitarianism spreads across Asia, Mrs. Gandhi's India remains a bastion against it, and therefore something in the U.S. interest to be preserved.

It is noteworthy mat even as Mrs. Gandhi fights to save her job and her political future, there is no indication that she intends to defy the courts, nor has any overt move been made to censor news reports carried by the government run All-India radio. A court in 'Allahabad, her home city in the state of Uttar Pradesh, declared that in her landslide victory of 1971 she had violated election-laws on two counts and so must give up her seat in parliament. Without her. seat in parliament she could not serve as prime minister.

The case was brought against her by the man she defeated and even in what has been called the post-Watergate morality of the United States, the two counts against her would not be considered any great sin. The two counts on which she was found guilty were that she had used a government official to campaign for her and that she had used local officials and policemen to arrange rallies for her. The court also barred her from polities for sis years but gave her 20 days in which to appeal to the supreme court Mrs. Gandhi has rejected demands that she resign and has charged her opponents with harassing her because she worked "for the larger good of the masses." In the midst of political uncertainty, a pressing problem for Mrs. Gandhi's Congress party is the question of a possible successor if the supreme court should rule against her.

One of those mentioned is Defense Minister Swaran Singh, but he like others lacks a political base. Other solutions have been suggested and rejected, including the possibility that Mrs. Gandhi's huge majority in parliament simply could pass new legislation suspending the constitution and giving her dictatorial powers- Disorders which such a move might touch off could topple the government, with accompanying new uncertainties including the attitude of the army.
