In the past, the Battery Maritime Building was used as storage space and a refuge by homeless until the cultural project started. But until the real estate deal for the proposed South Ferry Plaza is complete, the city is letting the groups use the space free of charge. The two groups will probably not be permanent, full-time tenants until the mid-90s. "Right now, the commercial real estate market is a little soft," noted David White, director of Dance Theater Workshop, "and the deal for the South Ferry Plaza is still being put together." Several groups of artists have been working since January and installed artwork which relates to maritime and political history.

And on the very first day, an art controversy developed. The two arts groups, Creative Time and Dance Theater Workshop, were chosen to be the cultural tenants.

They have use of one floor, the rooftop and the Weehaw-ken Ferry entrance area, as well as a few old piers. The building on the water at South and Whitehall Sts. is an official New York City landmark. An elaborate Beaux Arts-style building built in 1909, it was used as a ferry slip for South Brooklyn-bound boats until 1938. It is destined to be part of a proposed $400 million real es Affairs Commissioner Mary Schmidt Campbell.

"New York has been cited as having the most aggressive real estate-cultural initiatives." In addition to the exhibition, dance and other types of theater performances will be held. The first public performance, "Half A World Away," by A. Leroy and Janie Geiser, will be held on May 26-27 at 2 and 4 p.m. there is an enlargement a diagram of a slave slip which sailed into New York. "This is definitely an unusual project," said Cultural Jonathan Lovett, the lawyer for the coalition, said the case was not lost and "We are going to pursue our to make the facility the best it can be," he said. In a two-page ruling, the appeals court said the Legislature had dealt with the issues presented to the court and there was "no indication this determination was affected by an error of law or was arbitrary and capricious." It said there was no likelihood of success in the case and therefore denied a preliminary injunction against clearing the land. WestHELP's founder and president, Andrew Cuomo, called the decision good news for both the homeless and for taxpayers who pay the cost of keeping them in hotels.
