Tlio Constitution Section 2 of Article VIII. expressly declares, No tnonoy uluill be pniil out of tlio Treasury, except in purauanco of an appro priation by law." By nn act of tlio Legislature, passed Mnrcli 15th, 1851, $1,022,88 woro appropriated to Nelson Dewoy, to pay the contingent expen ses he had incurred tlio year previous above tlio appropriation, and also 1,000 fur the contingent expenses of tlio year 181. Gov.

Dfwey used up Iho whole of this contingent fund, and of the Swamp Land appropriation, and having, by a proccduro unauthorized by law, got hold of duu this Stato from United States, though re quired by a Joint Resolution of tlio Legislature to pay thu whole sum into tlio Treasury, ho paid tho Treasurer but 1, 1 12,.01 nnd in violation of law he paid of it for expenses which ho had incurred without a shadow of legal authority. Eight Hundred and Ninety Dollars (S800) of this sum he paid Geo. P. Delaplainc, his Private Secretary, for going to Washington nnd settling with tho Treasury Department for a bargain his Private Secretary made for station ery, at largo prices, with Win, A. Wheeler nnd S812.01 for contingent expenses generally.

Smith, todufraytho oxpense of compiling a documentary history of Wisconsin. also ''passed the, Senate "bill, to rato Doublo hcaded Brown, with 'two 'run of saws," with nn amendment that both saws run on ono crank," in which tho concurrence of tho Senato was requested. The Assembly havo passed a bill appropriating S500 to tho Stato Agricultural Society, to bo expended in premiums, or in purchasing seods and p'nnts for distribution. It passed tho Fox nnd Wisconsin River Improvement bill over the Governor Veto, 13 to 0, not even giving tho Message the courtesy of five minutes' consideration, waiting to havo it entered on tho Journal.
