The amount was the profit on a certain investments with Grant Ward oa Government coatraots. The witness ooold not remember the form of tho obligation, bat It was due oa that day (May 6, 1884). Tha differences due on the Investments resulted In hi getting the check for $71,800. All the contracts were made direct with Ward la his private effiee. Oa May 6, he received a oontraet for a much larger sum than 971,800, which only represented the profit oa the old transaction.

Mr. Warner did not know where the oontraola were, bat thought that possibly he had some ia his possession. Receiver Device Teetlfle. Julian T. Davie, the Receiver for the firm of Qrant ft Ward, aexl testified thet he took possession of the asset of Grant ft Ward on May 8.

1884. He had a partial list of the securities of the arm, whioh were found in boxes in ths Bankers' Safe Deposit Company, whioh plane the witneas had visited ia com. pany with U. B. Qrant, Jr.
