The witnesses also placed the killing at the restaurant, he added. Cutolo, of 1552 Coleman Brooklyn, was arrested at the restaurant yesterday morning and arraigned in Brooklyn Supreme Court.

Tropiano, of 8 Tuttle Staten Island, was placed under house arrest in the intensive care unit of Staten Island Hospital, which he entered Sunday after a purported heart attack. Tropiano, 60, an alleged soldier in the Colombo family, and his godson, William Cutolo, 25, a Colombo associate, were indicted in the June 1974 slaying of James Nagi, whose body was found in a padlocked oil drum floating in the East River. Report Contract on Nagi Authorities said that Nagi, 25, of 140 Luquer Brooklyn, was a Colombo soldier hired by a rival gang to finger mob members for the stickup ring. A contract was out for Nagi's death, they said. Noting that "it's rare to get a murder indictment in a case of this kind," Gold said that more than 10 0 persons were interviewed and 39 subpenaed before the grand jury to piece together the facts of the case.

The investigation revealed that Nagi was shot four times and killed on the night of June 17, 1974. Ballistics tests of the 32-caliber slugs found in the body disclosed that they had been fired from two weapons.
