Day of the state tax commission In charge of Investigating filings of tax returns In Erle-co announced Wednesday. In addition to this number there are said to be some 400 who failed to file returns on taxable tangible property. The Investigation Is being made by G. A. Hartz and J.

C. Phinney who are working under Mr. Day, Caldwell, who is Investigating Erie and eight other counties. Those who have failed to file returns will be cited to appear before the tax commission representatives and will be required to declare their properties and for failure to make return on the proper date penalties must be assessed. The tax commission has private Information furnished by corporation records showing actual payments of dividends and.

It is apparent it is through these sources that the alleged delinquencies have been found. Reports' of dividend checks are checked against the personal tax listings and If not included the receiver of the dividend is cited. Under the new law each corporation must furnish the state a report of all dividend payments. Tax must be paid upon all Income producing holdings. Collections under the Intangible law in Erie-co were among the highest in the state particularly in view of the faat that the state is to take some $10,000 of local tax moneys for distribution to counties, which failed to meet the quota of loss of revenue under the new statute.

Cuyahoga-co collected so much le.ss that it will share in the money assessed from Erie-co. The collections here averaged 70 per cent of anticipation, or more. However the stale Is determined to make every prospective taxpayer under the new law pay the tax required. Failure to answer the summons of the state tax investigators might have serious consequences, it is said. The examiners have set up an office in the auditor's office, MORE DAMAGE CLAIMS Two more damage actions were filed in common pleas court Wednesday, Charles Pomerson sued Arthur Lamp for $5,000.

He says that on Aug. 23, 1930. he was sitting on the running board of his truck afwaltlng a mechanic, near Mitiwanga, and the defendant's car struck from the rear. He says the defendant's car was negligently driven and that Injury to his leg inhibits him In work as a truck drver, Tom Pomerson, owner of the truck sued Lamp for $650 damages. Krueger, Roslno Moore filed the cases.

RETURNED TO PRISON John Campbell, arrested by police OR charges of carrying concealed weapons, was released by Judge Savord to B. Rule of the Ohio Stale Penitentiary. Rule returned Campbell to prison as a parole violator as he had been released but a short while when rearrested.
