If they had, they would have seen not only canceled checks allegedly written by Rico to himself, but also check registers with missing names, according to the Sept. 2 memo. "Mr.

Rico did not appear to en- ter any payee name when he was issuing checks he would forge," wrote Harrington. Harrington explained that most embezzlers dont dare take time off from work out of fear of discovery. He said Rico took as much as a month off every year and that, according to the Juvenile Probation staff, no one opened Rico's mail or checked the revolving fund while Rico was out Only once, Harrington reported, were any bills paid in Rico's absence, according to staff. "Juvenile Probation financial managers have told mv auditors warned by another employee in May months before the first bogus checks were discovered that $100,000 was missing from the revolving fund. They had also been warned by former Mayor Frank Jordan's office that an anonymous caller had said Rico liked to bet on the horses and that he parked a city car at Bay Meadows horse track on Wednesday afternoons.

Following The Examiner article, the director of finance for Juvenile Probation, Ace Tago, resigned. Tago could not be reached for comment. The controller and the district attorney have been investigating the Probation accounting department since mid-August when the alleged embezzlement scheme began to unravel. Controller Harrington has also been conducting an internal investigation to find out if any collusion took place in his office. District Attorney Terence Hallinan has questioned why the controller's office replenished the probation fund so frequently, and has suggested Rico must have gotten some help from somebody there.

Not only has the controller's office been under fire from the district attorney, but Mayor Brown called for an independent audit of all city departments. Harrington tried to deflect criticism aimed at his office for failing to discover the alleged theft. "Over 1,000 city staff accountants, account clerks, analysts, inventory clerks and managers have authority to originate accounting requests for payment," he wrote in his preliminary report. "The controller's office has 15 staff that review and process all of them." Harrington wrote that his staff relied too heavily on Probation Department fiscal controls. "In addition, Mr.

Rico was not following all of the guidelines in the use of this fund and he was requesting replenishment more often than should have been considered normal," he wrote. "Additional training will be given to staff." In his report, the controller also alleges that not only did Rico write checks to himself, but to "an accomplice, Carmelita Banayad." "Maybe I didn't use the right word (accomplice)," said Harrington, during an interview. "I'm not a lawyer." Hallinan said Banayad, who is believed to be Rico's daughter-in-law, is not a suspect. "We'd certainly like to talk to her," he said. "We think she's in the Philippines." A law enforcement source who asked to be unnamed said there's no indication Banayad endorsed any bogus checks or received any stolen money.
