The release also would mean Cortes and his insurance companies must pay any costs of treatment for the injury, which may require an operation. He originally hurt the hand during the Gators' season, either while swinging a bat or after tripping over first base and landing on the hand. Cortes also seems to have little chance of regaining his eligibility. to wait. Detroit minor-league officials have filed to nullify his contract, which would mean the 16th round pick's small bonus would not be paid.

Neither the Tigers nor Cortes have revealed the details of the contract, but it is believed to be for less than $3,000. Since Cortes has never been paid and his professional career spanned only four days, the Tigers and San Francisco State officials plan to petition the NCAA to regain his eligibility. That seems most unlikely. Cortes returned to the Bay Area last week to try to arrange a student loan to finish his senior year. Despite his frustration, Cortes retains a positive attitude.

"I'm just going to keep putting my faith in the Lord," he said. "It's unfair, but life has its ups and downs. Right now I'm not thinking about baseball, and that's kind of hard. It seems like I've practiced every day of my life, and given up everything else. I'm sure when I get my chance, I'll make the best of it." Cortes made the best of his year with the Gators, batting .479 with "I don't believe eligibility has ever been restored in a similar situation," said Janet Justice, an administrator in the NCAA office that oversees eligibility.

"He has professionalized himself by signing, and it's hard to get your eligibility restored once you're professionalized." Justice added that all decisions are made on a case-by-case basis. She would encourage S.F. State to appeal because of the unusual circumstances, she added. While the prospects for the im mediate future seem bleak, Cortes will probably receive another shot with the Tigers next year. "Probably what we would do, and I wouldn't guarantee it, but I would say there's a 90 percent chance we'll invite him to spring training in March," the Tigers' Miller said.

"That's the only right thing we should do." Should the contract be voided, Cortes would become a free agent, eager to accept another offer. "Tell anybody out there that I'm ready to sign if they want me," he said. After savoring the glories of baseball, Hernan Cortes has discovered the horrors.
