Guy Saved by Prank Cops Plea at Retrial help of a childish prank. He interrupted his retrial in Criminal Part of Queens Supreme Court to plead guilty to lesser charge, second degree assault. Anderson, of 307 Adelphi St., Brooklyn, was accused of stabbing to death laborer Pettie Davis, 40, after a fight on Dee. 29. The Kid's Stuff - His first trial via halted May 1 when a 9-year-old passed a juror a note which read: "Jerry is innocent . . . The DA is trying to railroad him ..." The youth was one of 150 children visiting the court as part of a Law Day observance. Justice George P. Stier gTanted a mistrial motion made by Anderson's attorney and blasted the design of the new $21 million courthouse, which required the jury to pass by the pctators' section on its way to deliberation rooms. It was while passing the spectators' railing that the boyish note was passed, ending the five-day trial. The mistrial cost the state $5,000. Going for Two Days Yesterday's interruption came on the second day of the retrial and after an all-male jury had been picked. The plea, for which Anderson can get up to 5 years in jail, was agreed to by Assistant District Attorney Moses Z. Yam and accepted by Justice J. Irwin Shapero. There were no children in court. Aug. 7 was set for sentencing. Third Ave. El Delay Mechanical trouble at 7:40 A.
