Wayne B. Williams, arrested Sunday, was questioned about the slayings and released less than three weeks ago. He became the first person charged with any of the killings of 23 of juveniles and adults. Public Safety Commissioner Lee Brown told a hastily called news conference at the Fulton County Jail on Sunday that Williams had been charged with "one count of criminal homicide" in the death of Nathaniel Cater, 27, whose body was found May 24 in the Chattahoochee River.

"That's something that's not to be discussed at this time." he said, adding that the investigation would continue "full steam ahead." After Williams was questioned June 3 and released 12 hours later. Brown said there was insufficient evidence for an arrest. He refused Sunday to discuss evidence gathered against Williams since then. However, an official close to the probe said the decision to charge Williams came after completion of additional lab tests comparing fibers from Cater's body with fibers taken from Williams' home.

Another official, who asked not to be identified, said a "consensus decision" to arrest Williams was reached Sunday afternoon when District Attorney Lewis Slaton met with Brown and other leaders of the special task force. WASHINGTON (AP) Justice Potter Stewart's departure from the Supreme Court is two weeks away, but it already has set off the biggest guessing game in town: Who will President Reagan select for the first opening on the court in six years? Within hours of Stewart's surprise announcement Thursday, a White House spokesman said the search for a successor got underway informally a month ago when Reagan was told of the justice's decision to retire. But no one in a position to know, least of all the president hfmself, was giving any hints as to who would be selected beyond dangling the possibility that it could be a woman, "There will be an announcement shortly," Reagan said. "We won't leave that vacant." The chief executive added that he was "always" on the lookout for someone to possibly become the court's first female member. He has hinted at that before, but has always stopped short of a public commitment to fill the first opening on the court with a woman.

Stewart, the affable Republican jurist Jong identified with the court's moderate middle ground, gave no' reason for his decision to retire July 3 and his office tried to quiet any speculation. "He's not going to be an ambassador, and he's not dying. There is no ulterior motive here." said Stewart's secretary, Carolyn Sand. She said the wealthy, 66- yearold justice was "retiring just to retire." Stewart invited reporters to a press conference possibly to give some reasons for leaving after 23 years the post he was entitled to keep for life. The last vacancy on the high court was created by the retirement of Justice William 0.

The search now will become more formal, according to Speakes. Any nominee will have to be approved by the Senate. Another presidential spokesman, David R. Gergen, said, "What we're looking for is the best qualified person, man or woman, but in that process highly qualified women would be given careful consideration." Most immediate speculation focused upon Smith, the attorney general and formerly Reagan's personal lawyer, and William Clark, a former California Supreme Court judge and close friend who now holds the No. 2 job at the State Department.
