Court to Test WLB Ruling Precedence Over State Law Challenged BIRMINGHAM July 28.

(AP) Authority of the National War Labor Board to supersede State law was challenged in an Alabama court today with prosecution, of a plant superin tendent who suspended a worker for non payment of union dues. State Labor' Director Emmett Brooks said Clem S. Walters superintendent of the Ingalls Iron Works Company, was charged with violating the State's Bradford Act guaranteeing "conv plete freedom" in joining, or not joining labor union. Complaint was filed by Clif ford Jenkins, an iron worker, who claimed he was suspended for non-payment of union dues under a maintenance of membership agreement validated by the Fourth Regional War Labor Board. The case was regarded as a test of War Labor Board supersedence of State law, and eventual appeal to the Supreme Court of the United States appeared certain.
